A bill for an act
relating to natural resources; modifying horse trail pass requirements; amending
Minnesota Statutes 2008, section 85.46, subdivisions 1, 3, 4, 7.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 85.46, subdivision 1, is amended to read:


Subdivision 1.

Pass in possession.

(a) Except as provided in paragraph (b), while
riding, leading, or driving a horse on horse trails and associated day use areas on state
trails, in state parks, in state recreation areas, and in state forests, a person deleted text begin 16 years of age
or over
deleted text end shall carry in immediate possession a valid horse trail passnew text begin for the horsenew text end . The pass
must be available for inspection by a peace officer, a conservation officer, or an employee
designated under section 84.0835.

(b) A valid horse trail pass is not required under this section for a deleted text begin person riding,
leading, or driving a
deleted text end horsenew text begin being ridden, lead, or drivennew text end only on the portion of a horse trail
that is owned by the personnew text begin riding, leading, or driving the horsenew text end or the person's spouse,
child, parent, or guardian.

a person under 16 years of age.

Sec. 2.

Minnesota Statutes 2008, section 85.46, subdivision 3, is amended to read:


Subd. 3.

Issuance.

The commissioner of natural resources and agents shall issue
and sell horse trail passes. The pass shall include the applicant's signaturenew text begin , identification
information for the horse,
new text end and other information deemed necessary by the commissioner.
To be valid, a pass must be signed by the deleted text begin person riding, leading, or drivingdeleted text end new text begin owner ofnew text end
the horse.

Sec. 3.

Minnesota Statutes 2008, section 85.46, subdivision 4, is amended to read:


Subd. 4.

Pass fees.

(a) The fee for an annual horse trail pass is $20 for deleted text begin an individual
16 years of age and over
deleted text end new text begin each horsenew text end . The fee shall be collected at the time the pass
is purchased. Annual passes are valid for one year beginning January 1 and ending
December 31.

(b) The fee for a daily horse trail pass is $4 deleted text begin for an individual 16 years of age and
over
deleted text end . The fee shall be collected at the time the pass is purchased. The daily pass is valid
only for the date designated on the pass form.

Sec. 4.

Minnesota Statutes 2008, section 85.46, subdivision 7, is amended to read:


Subd. 7.

Duplicate horse trail passes.

The commissioner of natural resources and
agents shall issue a duplicatenew text begin horse trailnew text end pass deleted text begin to a person whose passdeleted text end new text begin thatnew text end is lost or destroyed
using the process established under section 97A.405, subdivision 3, and rules adopted
thereunder. The fee for a duplicate horse trail pass is $2, with an issuing fee of 50 cents.
