  1.1                          A bill for an act 
  1.2             relating to health occupations; expanding the scope of 
  1.3             practice for pharmacists; amending Minnesota Statutes 
  1.4             2000, sections 151.01, subdivision 27; 151.37, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 151.01, 
  1.8   subdivision 27, is amended to read: 
  1.9      Subd. 27.  [PRACTICE OF PHARMACY.] "Practice of pharmacy" 
  1.10  means: 
  1.11     (1) interpretation and evaluation of prescription drug 
  1.12  orders; 
  1.13     (2) compounding, labeling, and dispensing drugs and devices 
  1.14  (except labeling by a manufacturer or packager of 
  1.15  nonprescription drugs or commercially packaged legend drugs and 
  1.16  devices); 
  1.17     (3) participation in clinical interpretations and 
  1.18  monitoring of drug therapy for assurance of safe and effective 
  1.19  use of drugs; 
  1.20     (4) participation in drug and therapeutic device selection; 
  1.21  drug administration for first dosage and, for medical 
  1.22  emergencies, and in accordance with section 151.37, subdivision 
  1.23  12; drug regimen reviews; and drug or drug-related research; 
  1.24     (5) participation in the practice of managing drug therapy 
  1.25  and modifying drug therapy, according to section 151.21, 
  2.1   subdivision 1, on a case-by-case basis according to a written 
  2.2   protocol between the specific pharmacist and the individual 
  2.3   dentist, optometrist, physician, podiatrist, or veterinarian who 
  2.4   is responsible for the patient's care and authorized to 
  2.5   independently prescribe drugs.  Any significant changes in drug 
  2.6   therapy must be reported by the pharmacist to the patient's 
  2.7   medical record; 
  2.8      (6) participation in the storage of drugs and the 
  2.9   maintenance of records; 
  2.10     (7) responsibility for participation in patient counseling 
  2.11  on therapeutic values, content, hazards, and uses of drugs and 
  2.12  devices; and 
  2.13     (8) offering or performing those acts, services, 
  2.14  operations, or transactions necessary in the conduct, operation, 
  2.15  management, and control of a pharmacy. 
  2.16     Sec. 2.  Minnesota Statutes 2000, section 151.37, is 
  2.17  amended by adding a subdivision to read: 
  2.18     Subd. 12.  [DRUG ADMINISTRATION.] (a) Notwithstanding 
  2.19  section 151.34, clause (1), a licensed pharmacist may administer 
  2.20  emergency contraception if the pharmacist: 
  2.21     (1) enters into a collaborative agreement with a licensed 
  2.22  practitioner that meets the requirements established by the 
  2.23  board of pharmacy and the board of medical practice; 
  2.24     (2) files the agreement with the board of pharmacy; and 
  2.25     (3) completes a training course approved by the board that 
  2.26  covers therapeutic information on emergency contraception, 
  2.27  patient care and counseling, and packing and labeling. 
  2.28     (b) The board of pharmacy, in consultation with the board 
  2.29  of medical practice, shall develop prescriptive protocols to be 
  2.30  included in the collaborative agreement between the pharmacist 
  2.31  and practitioner.
