A bill for an act
relating to health and the environment; establishing a Health Risk Advisory
Council; amending Minnesota Statutes 2006, section 103H.201, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 103H.201, is amended by adding a
subdivision to read:

(a) The commissioner shall establish a
Health Risk Advisory Council to provide advice to the commissioner on the following:

(1) the status of adopted health risk limits;
new text end
new text begin
(2) proposed health risk limits being considered for adoption or development;
new text end
new text begin
(3) proposed scientific research activities associated with establishment of health
risk limits; and
new text end
new text begin
(4) other subjects deemed appropriate by the council or the commissioner.

The council may convene forums, seminars, or other meetings to discuss
toxicological information on emerging environmental contaminants.

(b) The council will meet at least once annually or at the call of its chair, or upon
request of any four members. The terms, compensation, and removal of members of the
council shall be as provided in section 15.059, except that the council shall not expire
before June 30, 2010.

(c) The commissioner of health shall be an ex officio member and shall serve
as secretary of the council. The council shall elect a chair from its members or their
designees, by a concurring vote of not less than four members. The council shall be
comprised of:

(1) the commissioner of the Department of Agriculture;

new text begin
(2) the commissioner of the Pollution Control Agency;
new text end
new text begin
(3) a representative from a Minnesota-based industry involved in manufacturing
of chemical compounds;

new text begin
(4) the dean of the University of Minnesota School of Public Health;
new text end
new text begin
(5) a representative from one Minnesota-based nongovernmental organization
primarily engaged in environmental management or related interests;

new text begin
(6) the environmental health chair of the Minnesota Medical Association;
new text end
new text begin
(7) a director of a local government environmental health program; and
new text end
new text begin
(8) a representative from the United States Environmental Protection Agency.

(d) The commissioner shall establish a procedure and criteria for nomination and
selection of the council members that are not agency commissioners.
