  1.1                          A bill for an act 
  1.2             relating to crimes; prohibiting nonvehicular evasive 
  1.3             flight from a peace officer; providing penalties; 
  1.4             amending Minnesota Statutes 2002, section 609.487, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 609.487, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 6.  [FLEEING, OTHER THAN VEHICLE.] Whoever, for the 
  1.10  purpose of avoiding arrest, detention, or investigation, or in 
  1.11  order to conceal or destroy potential evidence related to the 
  1.12  commission of a crime, attempts to evade or elude a peace 
  1.13  officer, who is acting in the lawful discharge of an official 
  1.14  duty, by means of running, hiding, or by any other means except 
  1.15  fleeing in a motor vehicle, is guilty of a misdemeanor. 
  1.16     Sec. 2.  [EFFECTIVE DATE.] 
  1.17     Section 1 is effective August 1, 2004, and applies to 
  1.18  crimes committed on or after that date.
