  1.1                          A bill for an act
  1.2             relating to local government; requiring a sustainable 
  1.3             development planning guide and a model ordinance to be 
  1.4             developed for local government use by the office of 
  1.5             strategic and long-range planning; proposing coding 
  1.6             for new law in Minnesota Statutes, chapter 4A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [4A.07] [SUSTAINABLE DEVELOPMENT FOR LOCAL 
  1.9   GOVERNMENT.] 
  1.10     Subdivision 1.  [DEFINITIONS.] (a) "Local unit of 
  1.11  government" means a county, statutory or home rule charter city, 
  1.12  town, or watershed district.  
  1.13     (b) "Sustainable development" means development of land and 
  1.14  water areas that minimize environmental degradation while 
  1.15  providing economic opportunity and community well-being so that 
  1.16  the needs of the present are met without compromising the 
  1.17  ability of future generations to meet their own needs. 
  1.18     Subd. 2.  [PLANNING GUIDE.] By April 1, 1997, the office of 
  1.19  strategic and long-range planning must develop and publish a 
  1.20  planning guide for local units of government to plan for 
  1.21  sustainable development.  The office must make the planning 
  1.22  guide available to local units of government within the state. 
  1.23     Subd. 3.  [MODEL ORDINANCE.] By July 1, 1997, the office of 
  1.24  strategic and long-range planning, in consultation with 
  1.25  appropriate and affected parties, must prepare a model ordinance 
  1.26  to guide sustainable development. 
  2.1      Subd. 4.  [SPECIFICITY AND DISTRIBUTION.] The model 
  2.2   ordinance must specify the technical and administrative 
  2.3   procedures to guide sustainable development.  When adopted by a 
  2.4   local unit of government, the model ordinance is the minimum 
  2.5   regulation to guide sustainable development that may be 
  2.6   adopted.  Upon completion, the office of strategic and 
  2.7   long-range planning must notify local units of government that 
  2.8   the model ordinance is available, and must distribute it to 
  2.9   interested local units. 
  2.10     Subd. 5.  [PERIODIC REVIEW.] At least once every five 
  2.11  years, the planning office must review the model ordinance and 
  2.12  its use with local units of government to ensure its continued 
  2.13  applicability and relevance. 
  2.14     Sec. 2.  [EFFECTIVE DATE.] 
  2.15     This act is effective the day after final enactment.
