  1.1                          A bill for an act 
  1.2             relating to state government; revising provisions 
  1.3             governing compensation of boards and advisory groups; 
  1.4             amending Minnesota Statutes 2000, sections 15.059, 
  1.5             subdivision 3; 15.0575, subdivision 3; and 214.09, 
  1.6             subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 15.059, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [COMPENSATION.] Members of the advisory councils 
  1.11  and committees must be compensated at the rate of $55 a day 
  1.12  spent on council or committee activities, when authorized by the 
  1.13  council or committee, plus expenses in the same manner and 
  1.14  amount as authorized by the commissioner's plan adopted under 
  1.15  section 43A.18, subdivision 2.  Members who, as a result of time 
  1.16  spent attending council or committee meetings, incur child care 
  1.17  expenses that would not otherwise have been incurred, may be 
  1.18  reimbursed for those expenses upon council or committee 
  1.19  authorization.  If members who are state employees or employees 
  1.20  of political subdivisions receive the daily compensation, and if 
  1.21  the major part of their activities occur during normal working 
  1.22  hours for which they are also compensated by the state or 
  1.23  political subdivision, the employer shall deduct the daily 
  1.24  compensation from the employee's compensation for the day.  The 
  1.25  employer shall not deduct the daily compensation from the 
  1.26  employee's compensation for the day if the employee uses 
  2.1   vacation time for council or committee activities.  In no other 
  2.2   case may a member who is an employee of the state or a political 
  2.3   subdivision suffer a loss in compensation or benefits from the 
  2.4   state or political subdivision as a result of service on the 
  2.5   council or committee.  Members who are full-time state employees 
  2.6   or full-time employees of the political subdivisions of the 
  2.7   state may receive the expenses provided for in this section 
  2.8   unless the expenses are reimbursed by another source.  Members 
  2.9   who are state employees or employees of political subdivisions 
  2.10  of the state may be reimbursed for child care expenses only for 
  2.11  time spent on board activities that are outside their normal 
  2.12  working hours. 
  2.13     Sec. 2.  Minnesota Statutes 2000, section 15.0575, 
  2.14  subdivision 3, is amended to read:

  2.17  when authorized by the board, plus expenses in the same manner 
  2.18  and amount as authorized by the commissioner's plan adopted

  2.21  expenses that would not otherwise have been incurred, may be 
  2.22  reimbursed for those expenses upon board authorization.  Members 
  2.23  who are full-time state employees or full-time employees of the 
  2.24  political subdivisions of the state may not receive the daily 
  2.25  payment if the board activities occur during the employees' 
  2.26  scheduled working hours, but they may suffer no loss in 
  2.27  compensation or benefits from the state or a political 
  2.28  subdivision as a result of their service on the 
  2.29  board.  Full-time state employees or full-time employees of 
  2.30  political subdivisions of the state receive the daily payment if 
  2.31  they take vacation time or unpaid leave to serve on the board.  
  2.32  Members who are full-time state employees or full-time employees 
  2.33  of the political subdivisions of the state may receive the 
  2.34  expenses provided for in this subdivision unless the expenses 
  2.35  are reimbursed by another source.  Members who are state 
  2.36  employees or employees of political subdivisions of the state 
  3.1   may be reimbursed for child care expenses only for time spent on 
  3.2   board activities that are outside their normal working hours. 
  3.3      Sec. 3.  Minnesota Statutes 2000, section 214.09, 
  3.4   subdivision 3, is amended to read: 
  3.5      Subd. 3.  [COMPENSATION.] Members of the boards must be 
  3.6   compensated at the rate of $55 a day spent on board activities, 
  3.7   when authorized by the board, plus expenses in the same manner 
  3.8   and amount as authorized by the commissioner's plan adopted 
  3.9   under section 43A.18, subdivision 2.  Members who, as a result 
  3.10  of time spent attending board meetings, incur child care 
  3.11  expenses that would not otherwise have been incurred, may be 
  3.12  reimbursed for those expenses upon board authorization.  If 
  3.13  members who are full-time state employees or employees of the

  3.33     Sections 1 to 3 are effective July 1, 2001.
