  1.1                          A bill for an act
  1.2             relating to commerce; regulating advertisements for 
  1.3             cigarettes; restricting the placement of outdoor 
  1.4             advertisements for cigarettes; providing penalties and 
  1.5             remedies; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 325E. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [FINDINGS; LEGISLATIVE INTENT.] 
  1.9      The legislature finds that the advertisement of cigarettes 
  1.10  on billboards and other publicly visible signs harms minors by 
  1.11  influencing them to illegally purchase and smoke cigarettes 
  1.12  which endanger their health.  The purpose of section 2 is to 
  1.13  guard the health of minors by prohibiting advertisement of 
  1.14  cigarettes on billboards and other publicly visible signs. 
  1.15     Sec. 2.  [325E.255] [CIGARETTE ADVERTISEMENTS.] 
  1.16     Subdivision 1.  [PROHIBITION.] No person may place any 
  1.17  sign, poster, placard, device, graphic display, or other form of 
  1.18  advertising that advertises cigarettes in a publicly visible 
  1.19  location.  As used in this section, "publicly visible location" 
  1.20  includes outdoor billboards, sides of buildings, and 
  1.21  freestanding signboards. 
  1.22     Subd. 2.  [EXCEPTIONS.] Subdivision 1 does not apply to: 
  1.23     (1) any sign that contains a generic description of 
  1.24  cigarettes; or 
  1.25     (2) any sign on property adjacent to an interstate highway. 
  1.26     Subd. 3.  [PENALTIES.] A person who violates this section 
  2.1   is subject to the penalties and remedies in section 8.31.
