A bill for an act
relating to agriculture; establishing a temporary renewable fuel reimbursement
program for producers affected by COVID-19; appropriating money.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

$10,500,000 in fiscal year 2021 is appropriated from the coronavirus relief federal fund
to the commissioner of agriculture for a renewable fuel reimbursement program awarding
grants to biofuels production facilities that have suffered business interruptions or production
losses due to COVID-19. An applicant must show a biofuel production decrease from April
1 to August 30, 2020, compared to production between these dates in the previous calendar
year. The commissioner must determine a renewable fuel reimbursement rate per gallon
based on the amount of production decrease and the amount appropriated for this program.
The maximum grant for any one production facility is $500,000. The commissioner must
develop administrative procedures governing the application and grant award process. Any
funds that remain unexpended on November 30, 2020, are canceled. By December 31, 2020,
the commissioner must report to the legislature the number of applications received, the
number of grants awarded, and the grant amounts awarded. The report must also identify
the costs to administer the grant program and the amount canceled.
