A bill for an act
relating to education finance; implementing certain recommendations of the
legislative auditor regarding special education; authorizing rulemaking; requiring
a report; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin SPECIAL EDUCATION FEDERAL ALIGNMENT REVIEW.

new text begin The commissioner of education shall (1) review Minnesota Statutes and Minnesota
Rules to determine which state requirements exceed those under applicable federal law and
(2) analyze the economic and educational impacts of changes to these statutes and rules
to align to federal requirements. By February 15, 2014, the commissioner shall report to
the legislative committees with primary jurisdiction over early childhood education and
kindergarten through grade 12 education the findings under clauses (1) and (2).

Sec. 2. new text begin RULEMAKING AUTHORITY.

new text begin The commissioner of education shall amend Minnesota Rules related to the
provision of special education using the expedited rulemaking process in Minnesota
Statutes, section 14.389. The commissioner shall amend rules to align them consistent
with existing Minnesota Statutes.

appropriated from the general fund to the Department of Education for the fiscal years

of Enterprise Technology to develop model Individuals with Disabilities Education Act
(IDEA) online-available paperwork for special needs students:

new text begin This is a onetime appropriation and is available for spending until June 30, 2015.
Any ongoing information technology support or costs for online IDEA paperwork will be
incorporated into the service-level agreement and will be paid to the Office of Enterprise
Technology by the department under the rates and mechanisms specified in that agreement.
Any balance in fiscal year 2014 does not cancel but is available in fiscal year 2015.
