  1.1                          A bill for an act 
  1.2             relating to environment; requiring phosphorus 
  1.3             management plans for municipal wastewater facilities; 
  1.4             amending Minnesota Statutes 2002, section 115.44, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 115.44, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 9.  [PHOSPHORUS IN MUNICIPAL WASTEWATER TREATMENT 
  1.10  EFFLUENT.] (a) By August 1, 2004, all municipalities with 
  1.11  wastewater treatment facilities that have effluent phosphorus 
  1.12  concentrations greater than one milligram per liter shall 
  1.13  develop and submit a phosphorus management plan to the agency.  
  1.14  The plan must outline the corrective actions necessary to reduce 
  1.15  phosphorus discharges to a level no greater than one milligram 
  1.16  per liter. 
  1.17     (b) By August 1, 2007, all municipalities submitting a 
  1.18  management plan under paragraph (a) must implement the plan, and 
  1.19  a municipal wastewater treatment plant may not exceed one 
  1.20  milligram of phosphorus per liter of effluent.
