A bill for an act
relating to capital improvements; prohibiting certain appropriations for capital
improvements for state buildings being used for art.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PROHIBITION.

new text begin (a) Notwithstanding Minnesota Statutes, section 16B.35, or any other law to the
contrary, no part of an appropriation from the general fund or bond proceeds fund for
the construction or alteration of any state building may be used for the acquisition or
installation of works of art. For purposes of this section, "state building" has the meaning
given in Minnesota Statutes, section 16B.35, subdivision 1.

new text begin (b) This section does not prohibit expenditures from an appropriation from the arts
and cultural heritage fund under Minnesota Statutes, section 129D.17, from being used for
the purposes of acquiring or installing works of art in state buildings.

new text begin Section 1 is effective the day following final enactment and applies to any
appropriation finally enacted between January 1, 2009, and December 31, 2010.
