A bill for an act
relating to energy; providing for the Resilient Schools Act; establishing a
statewide energy conservation goal for public schools; requiring reports;
appropriating money; proposing coding for new law in Minnesota Statutes,
chapter 123B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

ARTICLE 1

RESILIENT SCHOOLS ACT

ARTICLE 2

STATEWIDE ENERGY CONSERVATION GOAL FOR PUBLIC SCHOOLS

Section 1.

PUBLIC SCHOOLS.

new text begin Statewide energy conservation goal for public schools. new text end

new text begin It is
an energy conservation goal of the state to obtain a 20 percent reduction in energy
consumption from all public schools in the aggregate by January 1, 2025, through the
implementation of cost-effective energy conservation measures, as defined in section
123B.65. The baseline for the reduction shall be energy usage data provided to the
Minnesota B3 benchmarking system between January 1, 2016, and December 31, 2016.
For purposes of this section, "public school" means an elementary school, middle school,
or secondary school, as defined in section 120A.05, subdivisions 9, 11, and 13.

new text begin By April 1, 2016, each
public school, or a school district reporting on behalf of a public school, shall update
existing or enter initial building information for buildings under its custodial control in
the Minnesota B3 benchmarking system. By April 1, 2017, each public school, or a
school district reporting on behalf of a public school, shall submit energy usage data to the
Minnesota B3 benchmarking system for the time period between January 1, 2016, and
December 31, 2016. Beginning in 2018, energy usage data for each public school shall be
updated annually by April 1. A school district shall submit energy usage data for buildings
under its custodial control that are not under custodial control of a public school.

identify, and enter the information in the Minnesota B3 benchmarking system, for all
major energy-consuming building systems in buildings under its custodial control that will
reach the end of their useful life within the next five years.

new text begin Beginning October 1, 2016, and updated annually
thereafter, the Department of Commerce shall report on its Web site progress toward the
statewide energy conservation goal for public schools.

Sec. 2. new text begin APPROPRIATION; BENCHMARKING OUTREACH.

new text begin $....... in fiscal year 2016 is appropriated from the general fund to the commissioner
of commerce for technical assistance and outreach efforts to ensure success of energy use
reduction and reporting for public schools under Minnesota Statutes, section 123B.651.
