  1.1                          A bill for an act 
  1.2             relating to the environment; extending the 
  1.3             notification requirements for landfarming contaminated 
  1.4             soil to unorganized townships; amending Minnesota 
  1.5             Statutes 1994, section 116.07, subdivision 11. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 116.07, 
  1.8   subdivision 11, is amended to read: 
  1.9      Subd. 11.  [PERMITS; LANDFARMING CONTAMINATED SOIL.] (a) If 
  1.10  the agency receives an application for a permit to spread soil 
  1.11  contaminated by a harmful substance as defined in section 
  1.12  115B.25, subdivision 7a, on land in a an organized or 
  1.13  unorganized township other than the township of origin of the 
  1.14  soil, the agency must notify the board of the organized 
  1.15  township, or the county board of the unorganized township where 
  1.16  the spreading would occur at least 60 days prior to issuing the 
  1.17  permit.  
  1.18     (b) The agency must not issue a permit to spread 
  1.19  contaminated soil on land outside the township of origin if, by 
  1.20  resolution, the township board of the organized township, or the 
  1.21  county board of the unorganized township where the soil is to be 
  1.22  spread requests that the agency not issue a permit.
