1.1A bill for an act
1.2relating to construction codes; providing a limited exemption.
1.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.4    Section 1. LIMITED EXEMPTION FROM STATE BUILDING CODE;
1.5REDWOOD COUNTY.
1.6(a) Notwithstanding any law to the contrary, an eligible structure described in
1.7paragraph (c) shall be exempted from compliance with the following automatic sprinkler
1.8system provisions:
1.9(1) the sprinkler system provision of the 2006 edition of the International Building
1.10Code, section 903.2.1.2, as adopted by the State Building Code; and
1.11(2) the sprinkler system provision of the 2006 edition of the International Fire Code,
1.12section 903.2.1.2, as adopted by the State Fire Code.
1.13(b) An eligible structure described in paragraph (c) that is exempt from and does not
1.14comply with the automatic sprinkler system provisions described in paragraph (a) shall
1.15comply with the following requirements in addition to the requirements of any other law:
1.16(1) the structure must have at least two times the minimum required exit width in
1.17permanently installed exit doors than the State Building Code or State Fire Code requires;
1.18(2) at any time that the structure is occupied by more than 100 people, it shall have a
1.19fire pumper with a rated capacity of at least 1,250 gallons per minute, a 1,000 gallon or
1.20larger booster tank, and two firefighters providing firewatch duty; and
1.21(3) the structure and the exemptions provided in this section must be approved in
1.22writing by the state fire marshal.
1.23(c) An eligible structure is one that:
2.1(1) is located in Redwood County and is on the property known as the Gilfillan
2.2Estate;
2.3(2) is owned by a historical society formed in 1949;
2.4(3) is currently less than 2,800 square feet in total area with an occupant load of
2.5fewer than 200 occupants, and, after expansion and renovation, will be less than 7,000
2.6square feet in total area with an occupant load of fewer than 400 occupants;
2.7(4) has use and occupancy classification codes of "A-2" and "B" under the 2006
2.8edition of the International Building Code, as adopted by the State Building Code; and
2.9(5) was built in 1998.
2.10(d) For purposes of certification of plans pursuant to Minnesota Statutes, section
2.11326.03, subdivision 1, and Minnesota Rules, chapters 1800 and 1805, if an architecture
2.12plan of a structure otherwise complies with applicable laws, ordinances, and building
2.13codes relating to design, any plan relating to a structure described in paragraph (c) that
2.14does not include plans for an automatic sprinkler system exempted in paragraph (a) shall be
2.15deemed to comply with applicable laws, ordinances, and building codes relating to design.
2.16(e) The exemption provided in this section expires July 1, 2019.
2.17EFFECTIVE DATE.This section is effective the day following final enactment.
