A bill for an act
relating to education; requiring school boards to
formally adopt and implement a policy about purchasing
and using irradiated food in food service programs;
amending Minnesota Statutes 2004, section 123B.02,
subdivision 13.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 123B.02,
subdivision 13, is amended to read:


Subd. 13.

School lunchesnew text begin ; irradiated foodnew text end .

new text begin (a) new text end The board
may furnish school lunches for pupils and teachers on such terms
as it determines.

new text begin (b) Before a district or charter school purchases
irradiated food or uses irradiated food in a food service
program, the district or school governing board at a regularly
scheduled board meeting must formally adopt a policy on
purchasing and using irradiated food in its food service
program. Any policy a board adopts under this paragraph must
include requirements to:

new text begin (1) notify parents of students at least 30 days before
initially purchasing irradiated food in a food service program;
new text end

new text begin (2) clearly identify all school lunch menu items by the
phrase "treated with irradiation" where applicable; and
new text end

new text begin (3) separate all irradiated food items from "nonirradiated"
food items served to students at a school meal or snack or
otherwise available for students to purchase or consume.

new text begin "Irradiated food" under this paragraph means food that has
been exposed to ionizing radiation.
