  1.1                          A bill for an act 
  1.2             relating to state lands; providing for the sale of 
  1.3             certain tax-forfeited lands in St. Louis, Koochiching, 
  1.4             Hennepin, and Fillmore counties; authorizing 
  1.5             conveyance of certain state lands to the city of 
  1.6             Eveleth; authorizing conveyance of lots within the 
  1.7             Mississippi headwaters corridor; authorizing a sale of 
  1.8             land to the city of Mankato; amending Laws 1995, 
  1.9             chapter 108, section 5. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  [TRANSFER OF NONCONFORMING SHORELAND LOTS 
  1.12  WITHIN MISSISSIPPI HEADWATERS CORRIDOR.] 
  1.13     Subdivision 1.  [DEFINITIONS.] The definitions in Minnesota 
  1.14  Statutes, section 103F.365, apply to this section. 
  1.15     Subd. 2.  [AUTHORIZATION.] Notwithstanding Minnesota 
  1.16  Statutes, section 103F.215, the counties of Crow Wing, Hubbard, 
  1.17  Cass, and Morrison may allow the sale or transfer, as a separate 
  1.18  parcel, of a lot within shoreland, as defined in Minnesota 
  1.19  Statutes, section 103F.205, subdivision 4, that: 
  1.20     (1) is located wholly within the Mississippi headwaters 
  1.21  corridor, as identified in the plan or is located anywhere 
  1.22  within Hubbard county; 
  1.23     (2) is one of a group of two or more contiguous lots that 
  1.24  have been under the same common ownership since July 1, 1981; 
  1.25  and 
  1.26     (3) does not meet the residential lot size requirements in 
  1.27  the model standards and criteria adopted by the commissioner of 
  2.1   natural resources under Minnesota Statutes, section 103F.211. 
  2.2      Subd. 3.  [SELLER TO INFORM BUYER.] Before a contiguous lot 
  2.3   is sold under the authority granted in subdivision 2, the seller 
  2.4   shall inform the buyer in writing of the extent to which the lot 
  2.5   does not meet the residential lot size requirements in the model 
  2.6   standards and criteria adopted by the commissioner of natural 
  2.7   resources under Minnesota Statutes, section 103F.211. 
  2.8      Subd. 4.  [REPEALER.] This section is repealed effective 
  2.9   January 1, 1997. 
  2.10     Sec. 2.  [PRIVATE SALE OF TAX-FORFEITED LAND BORDERING ON 
  2.11  PUBLIC WATER; ST. LOUIS COUNTY.] 
  2.12     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  2.13  282.018, subdivision 1, and the public sale provisions of 
  2.14  Minnesota Statutes, chapter 282, St. Louis county may sell by 
  2.15  private sale the tax-forfeited lands bordering public water that 
  2.16  are described in paragraphs (b), (c), and (d) under the 
  2.17  remaining provisions of Minnesota Statutes, chapter 282.  The 
  2.18  conveyances must be in a form approved by the attorney general.  
  2.19     (b) The land to be conveyed is located in Greenwood 
  2.20  township and is described as follows: 
  2.21     That part of unplatted Government Lot 5 in section 1, 
  2.22     Township 62, Range 17 lying within the following lines:  
  2.23     (1) on the south by the southerly line of Government Lot 5, 
  2.24     (2) on the west by the easterly line of the westerly 25 
  2.25     feet of Lot 2, Breezy Point Third Addition extended 
  2.26     northerly to the shoreline, and (3) on the east by the 
  2.27     easterly line of Government Lot 5, being .07 acres more or 
  2.28     less. 
  2.29     The property is a small intervening strip of land between 
  2.30  Lake Vermilion and private property.  The St. Louis county 
  2.31  auditor and assessor have reviewed the proposed sale and have 
  2.32  determined that the purchase price is equitable and that this 
  2.33  sale best serves the land management interests of St. Louis 
  2.34  county.  
  2.35     (c) The land to be conveyed is located in Greenwood 
  2.36  township and is described as follows:  
  3.1      That part of unplatted Government Lot 5 in Section 1, 
  3.2      Township 62, Range 17 lying within the following lines:  
  3.3      (1) on the south by the southerly line of Government Lot 5, 
  3.4      (2) on the west by the westerly line of Lot 2, Breezy Point 
  3.5      Third Addition extended northerly to the shoreline, and (3) 
  3.6      on the east by the easterly line of the westerly 25 feet of 
  3.7      Lot 2, Breezy Point Third Addition extended northerly to 
  3.8      the shoreline, being .02 acres more or less. 
  3.9      The property is a small intervening strip of land between 
  3.10  Lake Vermilion and private property.  The St. Louis county 
  3.11  auditor and assessor have reviewed the proposed sale and have 
  3.12  determined that the purchase price is equitable and that this 
  3.13  sale best serves the land management interests of St. Louis 
  3.14  county.  
  3.15     (d) The land to be conveyed is described as follows:  
  3.16     That part of the Southwest one-quarter of the Northwest 
  3.17     one-quarter of Section 5, Township 55 North, Range 14 West 
  3.18     of the 4th principal meridian, further described as 
  3.19     follows:  Beginning at the Northeast corner of said 
  3.20     Sixteenth Section which is a five-eighths inch iron rod, 
  3.21     thence Westerly on the North line a distance of 11.55 feet 
  3.22     to the highwater mark of Whiteface Reservoir, thence along 
  3.23     the highwater mark; azimuth=189 degrees, 36 minutes, 13 
  3.24     seconds a distance of 42.80 feet; thence azimuth=241 
  3.25     degrees, 00 minutes, 26 seconds a distance of 100.09 feet; 
  3.26     thence azimuth=264 degrees, 57 minutes, 17 seconds a 
  3.27     distance of 71.34 feet; thence azimuth=123 degrees, 53 
  3.28     minutes, 18 seconds a distance of 62.08 feet; thence 
  3.29     azimuth=157 degrees, 11 minutes, 24 seconds a distance of 
  3.30     50.37 feet; thence azimuth=103 degrees, 24 minutes, 42 
  3.31     seconds a distance of 56.77 feet; thence azimuth=63 
  3.32     degrees, 53 minutes, 21 seconds a distance of 59.80 feet to 
  3.33     a point on the East line of said Sixteenth Section; thence 
  3.34     Northerly on the East line a distance of 165.28 feet to the 
  3.35     point of beginning.  This parcel contains 0.36 acres more 
  3.36     or less.  
  4.1      This sale will resolve a problem arising from a resurvey.  
  4.2   The St. Louis county auditor and assessor have reviewed the 
  4.3   proposed sale and have determined that the purchase price is 
  4.4   equitable and that this sale best serves the land management 
  4.5   interests of St. Louis county. 
  4.6      Sec. 3.  [PUBLIC SALE OF TAX-FORFEITED LAND BORDERING ON 
  4.7   PUBLIC WATERS; ST. LOUIS COUNTY.] 
  4.8      Subdivision 1.  [SALE REQUIREMENTS.] (a) Notwithstanding 
  4.9   Minnesota Statutes, sections 92.45 and 282.018, subdivision 1, 
  4.10  St. Louis county may sell the tax-forfeited lands bordering 
  4.11  public water that are described in subdivision 2, under the 
  4.12  remaining provisions of Minnesota Statutes, chapter 282. 
  4.13     (b) The conveyance must be in a form approved by the 
  4.14  attorney general. 
  4.15     (c) The county has determined that the county's land 
  4.16  management interests would best be served if the lands were 
  4.17  returned to private ownership. 
  4.18     Subd. 2.  [DESCRIPTIONS.] The parcels of land that may be 
  4.19  conveyed are located in St. Louis county and, as set forth in 
  4.20  each of the following clauses, are legally described as 
  4.21  specified and are located on the water body named.  
  4.22     (1) Lots 88 and 89, Plat of Vermilion Dells, Sec. 11, Twp. 
  4.23  62, Rge. 16 W. Located on Lake Vermilion; 
  4.24     (2) That part of Lot 90 lying within Sec. 2, Twp. 62, Rge. 
  4.25  16 W. Located on Lake Vermilion; and 
  4.26     (3) That part of Lot 90 lying within Sec. 11, Twp. 62, Rge. 
  4.27  16 W. Located on Lake Vermilion. 
  4.28     Sec. 4.  [SALE OF TAX-FORFEITED LAND; KOOCHICHING COUNTY.] 
  4.29     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  4.30  282.018, subdivision 1, Koochiching county may sell for not less 
  4.31  than the appraised value the tax-forfeited land bordering public 
  4.32  water that is described in paragraph (c), under the remaining 
  4.33  provisions of Minnesota Statutes, chapter 282. 
  4.34     (b) The conveyance must be in a form approved by the 
  4.35  attorney general. 
  4.36     (c) The land that may be conveyed is three parcels. 
  5.1      Parcel number 1 is:  Plat of Forest Point - Lot 62. 
  5.2      Parcel number 2 is:  Two acres of Government Lot 2 
  5.3   described as follows: 
  5.4      Commencing at waters edge of Rainy River where 1/4 line on 
  5.5   West side of Lot 2 intersects said river, thence due South 40 
  5.6   rods alongside 1/4 line, thence due East 8 rods, thence due 
  5.7   North 40 rods, thence due West 8 rods to place of beginning.  
  5.8   Section 33, Township 160N, Range 26W. 
  5.9      Parcel number 3 is:  Plat of Mizpah - Lots 13, 14, 15, 16, 
  5.10  17, and 18, Block 4. 
  5.11     (d) The county has determined that the county's land 
  5.12  management interests would best be served if the lands described 
  5.13  in paragraph (c) were returned to private ownership. 
  5.14     Sec. 5.  [FILLMORE COUNTY; SALE OF TAX-FORFEITED LAND TO 
  5.15  THE CITY OF PRESTON.] 
  5.16     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  5.17  282.018, subdivision 1, and the public sale provisions of 
  5.18  Minnesota Statutes, chapter 282, Fillmore county may sell to the 
  5.19  city of Preston the tax-forfeited lands bordering the Root river 
  5.20  in the city of Preston that are described in paragraph (c), 
  5.21  under the remaining provisions of Minnesota Statutes, chapter 
  5.22  282. 
  5.23     (b) The conveyances must be in a form approved by the 
  5.24  attorney general and must provide that the land reverts to the 
  5.25  state of Minnesota if it is not used for recreational trail 
  5.26  purposes. 
  5.27     (c) The land that may be conveyed is legally described as 
  5.28  Lots 3 and 4, Block 3, John Kaercher's Addition, City of Preston.
  5.29     (d) The county has determined that the land is needed by 
  5.30  the city for recreational trail purposes. 
  5.31     Sec. 6.  [SALE OF TAX-FORFEITED LAND; HENNEPIN COUNTY.] 
  5.32     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  5.33  282.018, Hennepin county may sell the tax-forfeited land 
  5.34  bordering public water that is described in paragraph (c) under 
  5.35  the remaining provisions of Minnesota Statutes, chapter 282. 
  5.36     (b) The conveyance must be in a form approved by the 
  6.1   attorney general and subject to a restrictive covenant in a form 
  6.2   prescribed by the commissioner of natural resources, which 
  6.3   includes at least a 120-foot strip for protection along Shingle 
  6.4   Creek and also protection of associated wetlands. 
  6.5      (c) The land that may be conveyed is located in the city of 
  6.6   Brooklyn Park, Hennepin county, and is described as: 
  6.7      That part of the southwest quarter of the southeast quarter 
  6.8   of section 30, township 119, range 21, lying south of the north 
  6.9   520.14 feet thereof and lying northwesterly of a line drawn from 
  6.10  a point on the east line of said southwest quarter of the 
  6.11  southeast quarter distant 150.60 feet south of the northeast 
  6.12  corner thereof to a point on the south line of said southwest 
  6.13  quarter of the southeast quarter distant 80 feet east of the 
  6.14  southwest corner thereof. 
  6.15     (d) The county has determined that the county's land 
  6.16  management interests would best be served if the lands were 
  6.17  returned to private ownership. 
  6.18     Sec. 7.  Laws 1995, chapter 108, section 5, is amended to 
  6.19  read: 
  6.20     Sec. 5.  [SALE OF TRUST FUND LANDS.] 
  6.21     Notwithstanding any law to the contrary, the following 
  6.22  described trust fund lands, Lot 1, Block 1, Gold Mine on the 
  6.23  River, and Government Lot 7, except the part platted as Lots 2 
  6.24  and 3, all in Section 36, Township 67 North, Range 18 West, St. 
  6.25  Louis county, may be sold to the lessee under the provisions in 
  6.26  Minnesota Statutes, chapter 92. 
  6.27     Sec. 8.  [SALE OF IRRRB LANDS.] 
  6.28     Notwithstanding Minnesota Statutes, sections 94.09 to 
  6.29  94.13, the Iron Range Resources and Rehabilitation Board may 
  6.30  convey on behalf of the state, the land described in this 
  6.31  section to the city of Eveleth for no consideration.  The land 
  6.32  that may be conveyed is described as follows:  That part of the 
  6.33  Northwest one-quarter of the Northeast one-quarter of Section 
  6.34  17, Township 57 North, Range 17 West lying east of the east 
  6.35  right-of-way line of State Highway No. 53, and containing 1.31 
  6.36  acres more or less. 
  7.1      The conveyance must be in a form approved by the attorney 
  7.2   general, must provide that the land reverts to the state if it 
  7.3   ceases to be used for a public purpose, and must reserve to the 
  7.4   state all minerals and mineral rights.  The city of Eveleth must 
  7.5   pay any costs and expenses related to the conveyance. 
  7.6      The Iron Range Resources and Rehabilitation Board has 
  7.7   determined that this parcel of land is not needed for its 
  7.8   purposes and that the city of Eveleth needs it for municipal 
  7.9   purposes. 
  7.10     Sec. 9.  [MANKATO STATE UNIVERSITY.] 
  7.11     Mankato State University may sell to the city of Mankato 
  7.12  for fair market value approximately 2.66 acres of land in the 
  7.13  area of Warren Street, Stadium Road, and Hiniker Mill Road for 
  7.14  use as a detention basin.  The university may also grant the 
  7.15  city of Mankato a permanent utility easement in order to provide 
  7.16  the city access to the basin. 
  7.17     Sec. 10.  [EFFECTIVE DATE.] 
  7.18     Sections 1 to 9 are effective the day following final 
  7.19  enactment.
