A bill for an act
relating to capital investment; appropriating money for local roads and bridges;
authorizing grants for fracture-critical bridges; amending Minnesota Statutes
2008, section 174.50, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 174.50, is amended by adding a
subdivision to read:

new text begin Fracture-critical bridges. new text end

new text begin (a) The commissioner may make a grant to
any political subdivision for replacement or rehabilitation of a fracture-critical bridge. To
be eligible for a grant under this subdivision, the project must produce a bridge structure:

new text begin (1) that is no longer classified as fracture critical, by having alternate load paths; and
new text end

new text begin (2) whose failure of a main component will not result in the collapse of the bridge.

new text begin (b) A grant under this subdivision is subject to the procedures and criteria established
under subdivisions 5 and 6.

Sec. 2. new text begin APPROPRIATIONS; LOCAL ROADS AND BRIDGES

new text begin Local road improvement program. new text end

new text begin $60,000,000 is appropriated
from the bond proceeds account in the state transportation fund as provided in Minnesota
Statutes, section 174.50, to the commissioner of transportation for the local road
improvement program. Of this appropriation:

new text begin (1) $30,000,000 is for grants to counties to assist in paying the costs of rural road
safety capital improvement projects on county state-aid highways under Minnesota
Statutes, section 174.52, subdivision 4a; and

new text begin (2) $30,000,000 is for grants for construction and reconstruction of local roads with
statewide or regional significance under Minnesota Statutes, section 174.52, subdivision 4.

new text begin Local bridge replacement and rehabilitation. new text end

new text begin $20,000,000 is
appropriated from the bond proceeds account in the state transportation fund as provided
in Minnesota Statutes, section 174.50, to the commissioner of transportation for matching
federal funds and replacement or rehabilitation of local bridges under Minnesota Statutes,
section 174.50, subdivisions 6a and 6c.

new text begin To provide the money appropriated in this section from the
state transportation fund, the commissioner of finance shall sell and issue bonds of the
state in an amount up to $80,000,000 in the manner, upon the terms, and with the effect
prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota
Constitution, article XI, sections 4 to 7. The proceeds of the bonds, except accrued interest
and any premium received on the sale of the bonds, must be credited to a bond proceeds
account in the state transportation fund.
