A bill for an act
relating to health; modifying provisions governing reimbursable expenses for
nursing assistant training and competency evaluations; amending Minnesota
Statutes 2016, section 144A.611, subdivisions 1, 2, 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 144A.611, subdivision 1, is amended to read:


Subdivision 1.

Nursing homes and certified boarding care homes.

The actual costs
of tuition and textbooks and reasonable expenses for the competency evaluation or the
nursing assistant training program and competency evaluation approved under section
144A.61, which are paid to nursing assistants or adult training programs new text begin or their fiscal agents
new text end pursuant to subdivisions 2 and 4, are a reimbursable expense for nursing homes and certified
boarding care homes under section deleted text begin 256B.431, subdivision 36deleted text end new text begin 256R.37new text end .

Sec. 2.

Minnesota Statutes 2016, section 144A.611, subdivision 2, is amended to read:


Subd. 2.

Reimbursement for training program and competency evaluation costs.

new text begin (a) new text end A nursing assistant who has completed an approved competency evaluation or an
approved training program and competency evaluation shall be reimbursed by the nursing
home or certified boarding care home for actual new text begin incurrednew text end costs of tuition and textbooks and
reasonable expenses for the competency evaluation or the training program and competency
evaluation 90 days after the date of employment, or upon completion of the approved training
program, whichever is later.

new text begin (b) If the training or testing costs of a nursing assistant were paid by an entity receiving
state or federal funding for those costs and if the nursing assistant did not reimburse the
entity for those expenses, the nursing home or boarding care home shall directly reimburse
the entity that paid for the training and testing costs on behalf of the nursing assistant.

Sec. 3.

Minnesota Statutes 2016, section 144A.611, subdivision 4, is amended to read:


Subd. 4.

Reimbursement for adult basic education components.

(a) Nursing facilities
and certified boarding care homes shall provide reimbursement for costs related to additional
adult basic education deleted text begin componentsdeleted text end new text begin training intended to ensure successful completionnew text end of an
approved nursing assistant training program, to:

(1) an adult new text begin basic education new text end training programnew text begin , as defined in section 124D.52 and approved
by the commissioner of education,
new text end that provided deleted text begin an approved nursing assistant training
program to an employee of
deleted text end new text begin training to an individual hired as a certified nursing assistant by
new text end the nursing facility or boarding care home; or

(2) deleted text begin a nursing assistant who is an employee of the nursing facility or boarding care home
and completed an approved nursing assistant training program provided by an adult training
program
deleted text end new text begin a fiscal agent identified by an adult basic education training program specified in
clause (1)
new text end .

(b) For purposes of this subdivision, adult basic education new text begin training new text end components deleted text begin of a
nursing assistant training program
deleted text end must include the following, if needed: training in
mathematics, vocabulary, literacy skills, workplace skills, resume writing, and job interview
skills. Reimbursement provided under this subdivision shall not exceed 30 percent of the
new text begin total new text end cost of new text begin the nursing assistant training and testing for an individual, including new text end tuition,
deleted text begin textbooksdeleted text end new text begin textbook costsnew text end , and new text begin the cost of the new text end competency evaluation.

(c) An adult new text begin basic education new text end training program is prohibited from billing deleted text begin program students,deleted text end
nursing facilitiesdeleted text begin ,deleted text end or certified boarding care homes for costs under this subdivision until the
program student has been employed by the nursing facility as a certified nursing assistant
for at least 90 days.
