A bill for an act
relating to retirement; public employees police and fire retirement plan; clarifying
duty disability status for certain disabled members.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Notwithstanding a determination of the board of trustees of the Public Employees
Retirement Association to the contrary, an eligible person described in paragraph (b) is
entitled to a duty disability from the public employees police and fire retirement plan
under Minnesota Statutes, section 353.656, subdivision 1, if the employing unit of the
eligible person at the time of the disability has certified that the disability of the eligible
person occurred in the line of duty.

(b) An eligible person is a person who:

(1) was born on October 11, 1948;
new text end
new text begin
(2) was employed by Anoka County as a deputy sheriff from April 2, 1974, until
September 30, 1997;

(3) filed a disability application with the Public Employees Retirement Association
on May 20, 1997; and

new text begin
(4) was informed that the application for a disability benefit had been approved by
the Public Employees Retirement Association on September 10, 1997.

This section is effective the day following final enactment.
