  1.1                          A bill for an act 
  1.2             relating to agriculture; requiring a pollution control 
  1.3             agency animal feedlot registry; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 116. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [116.0714] [ANIMAL FEEDLOT REGISTRY.] 
  1.7      (a) Within one year of the effective date of this section, 
  1.8   an owner of an animal feedlot, with a capacity of 300 animal 
  1.9   units or more, shall register with the Minnesota pollution 
  1.10  control agency or the county authorized to issue animal feedlot 
  1.11  permits in the county where the animal feedlot is located, 
  1.12  providing information that meets the requirements of this 
  1.13  section.  Annually thereafter, the owner of the animal feedlot 
  1.14  shall file an updated registration form reporting any changes in 
  1.15  the information required under this section.  
  1.16     (b) After the effective date of this section, an owner of 
  1.17  an animal feedlot of any size applying for a renewed or new 
  1.18  permit shall, at the time of application, register with the 
  1.19  agency or the county authorized to issue animal feedlot permits 
  1.20  in the county where the animal feedlot is located, providing 
  1.21  information that meets the requirements of this section. 
  1.22     (c) An animal feedlot registration shall provide the 
  1.23  following information: 
  1.24     (1) the location of the animal feedlot; 
  1.25     (2) the type of livestock at the feedlot; 
  2.1      (3) the number of animal units kept at the feedlot; 
  2.2      (4) the type of manure storage structure used to store 
  2.3   manure from the feedlot; 
  2.4      (5) the names and addresses of all owners and operators of 
  2.5   the feedlot; and 
  2.6      (6) the names and addresses of all owners of the livestock 
  2.7   kept at the feedlot. 
  2.8      (d) Counties with delegated permitting authority shall 
  2.9   maintain the information required by this section and shall file 
  2.10  an annual report with the agency providing the data gathered 
  2.11  under this section. 
  2.12     (e) The agency shall maintain the data gathered under this 
  2.13  section in a centralized database.  Notwithstanding chapter 13, 
  2.14  the database shall be public record and subject to full 
  2.15  disclosure within five days upon request of any person. 
  2.16     (f) No new or renewed permit to operate an animal feedlot 
  2.17  shall be issued until the requirements of this section have been 
  2.18  met. 
  2.19     (g) Failure to report the information required by this 
  2.20  section may result in a suspension of a permit to operate an 
  2.21  animal feedlot until this section has been fully complied with. 
  2.22     (h) The governmental unit responsible for maintaining the 
  2.23  information required by this section may bring an action in 
  2.24  district court to enforce the provisions of this section. 
  2.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.26     Section 1 is effective the day following final enactment.
