  1.1                          A bill for an act 
  1.2             relating to Dakota county; changing the name of the 
  1.3             Dakota county housing and redevelopment authority; 
  1.4             providing for the powers of the Dakota county 
  1.5             community development agency; amending Minnesota 
  1.6             Statutes 1998, section 383D.41, subdivisions 1, 2, 3, 
  1.7             and by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 383D.41, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [HOUSING AND REDEVELOPMENT AUTHORITY 
  1.12  COMMUNITY DEVELOPMENT AGENCY.] There is hereby created in Dakota 
  1.13  county a public body corporate and politic, to be known as the 
  1.14  Dakota county housing and redevelopment authority community 
  1.15  development agency, having all of the powers and duties of a 
  1.16  housing and redevelopment authority under sections 469.001 to 
  1.17  469.047; which act applies to the county of Dakota.  For the 
  1.18  purposes of applying the provisions of the municipal housing and 
  1.19  redevelopment act sections 469.001 to 469.047 and 469.090 to 
  1.20  469.1081 to Dakota county, and subject to the provisions of this 
  1.21  section, the county has all of the powers and duties of a 
  1.22  municipality, the county board has all of the powers and duties 
  1.23  of a governing body, the chair of the county board has all of 
  1.24  the powers and duties of a mayor, and the area of operation 
  1.25  includes the area within the territorial boundaries of the 
  1.26  county. 
  2.1      Sec. 2.  Minnesota Statutes 1998, section 383D.41, 
  2.2   subdivision 2, is amended to read: 
  2.3      Subd. 2.  This section shall not limit or restrict any 
  2.4   existing housing and redevelopment authority or prevent a 
  2.5   municipality from creating an authority.  The county shall not 
  2.6   exercise jurisdiction in any municipality where a municipal 
  2.7   housing and redevelopment authority is established.  A municipal 
  2.8   housing and redevelopment authority may request the Dakota 
  2.9   county housing and redevelopment authority community development 
  2.10  agency to handle the housing duties of the authority and, in 
  2.11  such an event,.  If the municipal authority makes the request, 
  2.12  the Dakota county housing and redevelopment authority community 
  2.13  development agency shall act and have exclusive jurisdiction for 
  2.14  housing in the municipality pursuant to sections 469.001 to 
  2.15  469.047.  A transfer of duties relating to housing shall does 
  2.16  not transfer any duties relating to redevelopment. 
  2.17     Sec. 3.  Minnesota Statutes 1998, section 383D.41, 
  2.18  subdivision 3, is amended to read: 
  2.19     Subd. 3.  If any housing or project, development district 
  2.20  redevelopment project, or economic development project is 
  2.21  constructed in Dakota county pursuant to this authorization, and 
  2.22  such the project is within the boundaries of any incorporated 
  2.23  home rule charter or statutory city, the location of such the 
  2.24  project shall must be approved by the governing body of the 
  2.25  city, and: 
  2.26     (1) in the case of any housing project or housing 
  2.27  development project, by the municipal housing and redevelopment 
  2.28  authority established for the city if it has not previously 
  2.29  requested that the Dakota county community development agency or 
  2.30  its predecessor agency handle the housing duties of the 
  2.31  authority; or 
  2.32     (2) in the case of any redevelopment project by the 
  2.33  municipal housing and redevelopment authority established for 
  2.34  the city. 
  2.35     Sec. 4.  Minnesota Statutes 1998, section 383D.41, is 
  2.36  amended by adding a subdivision to read: 
  3.1      Subd. 7.  [DAKOTA COUNTY COMMUNITY DEVELOPMENT AGENCY.] (a) 
  3.2   After December 31, 1999, the Dakota county housing and 
  3.3   redevelopment authority shall be known as the Dakota county 
  3.4   community development agency.  In addition to the other powers 
  3.5   granted in this section, the Dakota county community development 
  3.6   agency shall have the powers of an economic development 
  3.7   authority under sections 469.090 to 469.1081 that are granted to 
  3.8   the agency by resolution adopted by the Dakota county board of 
  3.9   commissioners, except as provided in paragraph (b).  The agency 
  3.10  may exercise any of the powers granted to it under sections 
  3.11  469.001 to 469.047 and any of the powers of an economic 
  3.12  development authority granted to it by the Dakota county board 
  3.13  of commissioners for the purposes described in these sections. 
  3.14     (b) The Dakota county community development agency may not 
  3.15  levy the tax described in section 469.107, but with the approval 
  3.16  of the Dakota county board may increase its levy of the special 
  3.17  tax described in section 469.033, subdivision 6, to an amount 
  3.18  not exceeding 0.01813 percent of net tax capacity, or any higher 
  3.19  limit authorized under section 469.107 or 469.033, subdivision 6.
  3.20     Sec. 5.  Minnesota Statutes 1998, section 383D.41, is 
  3.21  amended by adding a subdivision to read: 
  3.22     Subd. 8.  [EXEMPTION FROM SALES TAX AND 
  3.23  CHARGES.] Notwithstanding any other law, the Dakota county 
  3.24  community development agency is exempt from the payment of: 
  3.25     (1) sales tax on purchases of construction materials and 
  3.26  equipment; and 
  3.27     (2) the portion of any sewer access charges and water 
  3.28  access charges, which is ultimately payable to the metropolitan 
  3.29  council; 
  3.30  in connection with the development of housing development 
  3.31  projects that are intended for occupancy by persons and families 
  3.32  with incomes at levels required for projects receiving 
  3.33  low-income housing tax credits or which constitute a qualified 
  3.34  housing development project. 
  3.35     Sec. 6.  Minnesota Statutes 1998, section 383D.41, is 
  3.36  amended by adding a subdivision to read: 
  4.1      Subd. 9.  [OFFERS OF TAX-FORFEITED LANDS.] Notwithstanding 
  4.2   any other law, Dakota county may offer to the Dakota county 
  4.3   community development agency, under the conditions and policies 
  4.4   established by the county, nonconservation tax-forfeited land 
  4.5   prior to making the properties available to cities in Dakota 
  4.6   county. 
  4.7      Sec. 7.  [INSTRUCTION TO THE REVISOR.] 
  4.8      In the 2000 edition of Minnesota Statutes, the revisor of 
  4.9   statutes shall change "Dakota county housing and redevelopment 
  4.10  authority" to "Dakota county community development agency" 
  4.11  wherever it appears.
