  1.1                          A bill for an act 
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to develop a plan to secure medical 
  1.4             assistance for mental health services provided in 
  1.5             out-of-home placement settings. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [MEDICAL ASSISTANCE FOR MENTAL HEALTH SERVICES 
  1.8   PROVIDED IN OUT-OF-HOME PLACEMENT SETTINGS.] 
  1.9      The commissioner of human services shall develop a plan in 
  1.10  conjunction with representatives from counties, provider groups, 
  1.11  and other stakeholders, to secure medical assistance funding for 
  1.12  mental health-related services provided in out-of-home placement 
  1.13  settings, including treatment foster care, group homes, and 
  1.14  residential programs licensed under Minnesota Statutes, chapters 
  1.15  241 and 245A.  The plan must include proposed legislation, 
  1.16  fiscal implications, and other pertinent information. 
  1.17     Treatment foster care services must be provided by a child 
  1.18  placing agency licensed under Minnesota Rules, parts 9543.0010 
  1.19  to 9543.0150 or 9545.0755 to 9545.0845.  
  1.20     The commissioner shall report to the legislature by January 
  1.21  15, 2004.
