  1.1                          A bill for an act 
  1.2             relating to human services; adding an exception to the 
  1.3             group residential housing moratorium; amending 
  1.4             Minnesota Statutes 1994, section 256I.04, subdivision 
  1.5             3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 256I.04, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [MORATORIUM ON THE DEVELOPMENT OF GROUP 
  1.10  RESIDENTIAL HOUSING BEDS.] (a) County agencies shall not enter 
  1.11  into agreements for new group residential housing beds except:  
  1.12  (1) for group residential housing establishments meeting the 
  1.13  requirements of subdivision 2a, clause (2); (2) for group 
  1.14  residential housing establishments licensed under Minnesota 
  1.15  Rules, parts 9525.0215 to 9525.0355, provided the facility is 
  1.16  needed to meet the census reduction targets for persons with 
  1.17  mental retardation or related conditions at regional treatment 
  1.18  centers; (3) to ensure compliance with the federal Omnibus 
  1.19  Budget Reconciliation Act alternative disposition plan 
  1.20  requirements for inappropriately placed persons with mental 
  1.21  retardation or related conditions or mental illness; or (4) up 
  1.22  to 80 beds in a single, specialized facility located in Hennepin 
  1.23  county that will provide housing for chronic inebriates who are 
  1.24  repetitive users of detoxification centers and are refused 
  1.25  placement in emergency shelters because of their state of 
  2.1   intoxication; or (5) for up to 180 supportive housing units, 
  2.2   notwithstanding the provisions of subdivision 2a, in Anoka, 
  2.3   Dakota, Hennepin, or Ramsey county for homeless adults with a 
  2.4   mental illness, a history of substance abuse, or human 
  2.5   immunodeficiency virus or acquired immunodeficiency syndrome.  
  2.6   Planning for the specialized facility must have been initiated 
  2.7   before July 1, 1991, in anticipation of receiving a grant from 
  2.8   the housing finance agency under section 462A.05, subdivision 
  2.9   20a, paragraph (b). 
  2.10     For purposes of this section, "homeless adult" means a 
  2.11  person who has no permanent address or is evicted from a 
  2.12  dwelling unit or discharged from a regional treatment center, 
  2.13  community hospital, or residential treatment program and has no 
  2.14  appropriate housing available and lacks the resources and 
  2.15  support necessary to access appropriate housing.  If a person 
  2.16  meets the requirements of subdivision 1, paragraph (a), the 
  2.17  group residential housing rate for that person is limited to the 
  2.18  supplementary rate under section 256I.05, subdivision 1a, and is 
  2.19  determined by subtracting the amount of the person's countable 
  2.20  income that exceeds the MSA equivalent rate from the group 
  2.21  residential housing supplementary rate.  
  2.22     (b) A county agency may enter into a group residential 
  2.23  housing agreement for beds in addition to those currently 
  2.24  covered under a group residential housing agreement if the 
  2.25  additional beds are only a replacement of beds which have been 
  2.26  made available due to closure of a setting, a change of 
  2.27  licensure or certification which removes the beds from group 
  2.28  residential housing payment, or as a result of the downsizing of 
  2.29  a group residential housing setting.  The transfer of available 
  2.30  beds from one county to another can only occur by the agreement 
  2.31  of both counties. 
  2.32     (c) Group residential housing beds which become available 
  2.33  as a result of downsizing settings which have a license issued 
  2.34  under Minnesota Rules, parts 9520.0500 to 9520.0690, must be 
  2.35  permanently removed from the group residential housing census 
  2.36  and not replaced.
