A bill for an act
relating to civil law; providing certain liability protections for those grazing
livestock on state land; proposing coding for new law in Minnesota Statutes,
chapter 604A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Except as provided in paragraph (b), a nonprofit corporation, association, or
organization, or a person or other entity grazing livestock on state lands under agreement
with the commissioner of natural resources is not liable for the death of or an injury to
a person due to that livestock as a result of the inherent risks of livestock activities, as
defined under section 604A.12, subdivision 1, paragraph (b).

(b) Nothing in paragraph (a) relieves any nonprofit corporation, association, or
organization, or a person or other entity grazing livestock on state lands from any duty that
the person may have in the absence of this section to exercise reasonable care in using the
land for grazing and in managing the livestock.

(c) The death or injury caused by the livestock activities is not the result of
an inherent risk of livestock activities if the nonprofit corporation, association, or
organization, or a person or other entity maintained a condition in violation of the
agreement with the commissioner of natural resources with willful or reckless disregard
for the safety of persons handling or interacting with the livestock.

This section is effective July 1, 2011, and applies to causes
of action occurring on or after that date.
