  1.1                          A bill for an act 
  1.2             relating to traffic regulations; providing for speed 
  1.3             limits of 65 miles per hour during daytime and 55 
  1.4             miles per hour during nighttime on paved two-lane 
  1.5             highways; amending Minnesota Statutes 2002, sections 
  1.6             169.14, subdivision 2; 169.99, subdivision 1b; 171.12, 
  1.7             subdivision 6. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 169.14, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [SPEED LIMITS.] (a) Where no special hazard 
  1.12  exists the following speeds shall be lawful, but any speeds in 
  1.13  excess of such limits shall be prima facie evidence that the 
  1.14  speed is not reasonable or prudent and that it is unlawful; 
  1.15  except that the speed limit within any municipality shall be a 
  1.16  maximum limit and any speed in excess thereof shall be unlawful: 
  1.17     (1) 30 miles per hour in an urban district or on a town 
  1.18  road in a rural residential district; 
  1.19     (2) 65 miles per hour on non-Interstate freeways and 
  1.20  expressways, as defined in section 160.02, subdivision 19; 
  1.21     (3) 65 miles per hour on paved highways other than freeways 
  1.22  and expressways outside urban districts during daytime; 
  1.23     (4) 55 miles per hour on paved highways other than freeways 
  1.24  and expressways outside urban districts during nighttime; 
  1.25     (5) 55 miles per hour in locations other than those 
  1.26  specified in this section; 
  2.1      (4) (6) 70 miles per hour on Interstate highways outside 
  2.2   the limits of any urbanized area with a population of greater 
  2.3   than 50,000 as defined by order of the commissioner of 
  2.4   transportation; 
  2.5      (5) (7) 65 miles per hour on Interstate highways inside the 
  2.6   limits of any urbanized area with a population of greater than 
  2.7   50,000 as defined by order of the commissioner of 
  2.8   transportation; 
  2.9      (6) (8) ten miles per hour in alleys; and 
  2.10     (7) (9) 25 miles per hour in residential roadways if 
  2.11  adopted by the road authority having jurisdiction over the 
  2.12  residential roadway.  
  2.13     (b) A speed limit adopted under paragraph (a), 
  2.14  clause (7) (9), is not effective unless the road authority has 
  2.15  erected signs designating the speed limit and indicating the 
  2.16  beginning and end of the residential roadway on which the speed 
  2.17  limit applies. 
  2.18     (c) For purposes of this subdivision, "rural residential 
  2.19  district" means the territory contiguous to and including any 
  2.20  town road within a subdivision or plat of land that is built up 
  2.21  with dwelling houses at intervals of less than 300 feet for a 
  2.22  distance of one-quarter mile or more. 
  2.23     Sec. 2.  Minnesota Statutes 2002, section 169.99, 
  2.24  subdivision 1b, is amended to read: 
  2.25     Subd. 1b.  [SPEED.] The uniform traffic ticket must provide 
  2.26  a blank or space wherein an officer who issues a citation for a 
  2.27  violation of section 169.14, subdivision 2, paragraph (a), 
  2.28  clause (3), (4), or (5), must specify whether the speed was 
  2.29  greater than ten miles per hour in excess of the lawful speed. 
  2.30     Sec. 3.  Minnesota Statutes 2002, section 171.12, 
  2.31  subdivision 6, is amended to read: 
  2.32     Subd. 6.  [CERTAIN CONVICTIONS NOT RECORDED.] The 
  2.33  department shall not keep on the record of a driver any 
  2.34  conviction for a violation of section 169.14, subdivision 2, 
  2.35  paragraph (a), clause (3), (4), or (5), unless the violation 
  2.36  consisted of a speed greater than ten miles per hour in excess 
  3.1   of the lawful speed.
