A bill for an act
relating to environment; requiring rulemaking for certain environmental review
and solid waste land disposal facility permits.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RULEMAKING; ENVIRONMENTAL REVIEW AND SOLID WASTE
LAND DISPOSAL FACILITY PERMITS.

new text begin Environmental Quality Board. new text end

new text begin The Environmental Quality Board
shall amend Minnesota Rules, part 4410.0200, subpart 65, to state that if the proposed
action concerns a solid waste land disposal facility:

new text begin (1) the project for review shall be defined by the proposer based on the requirements
of the category; and
new text end

new text begin (2) the responsible governmental unit shall review the project proposed, in
conjunction with any existing facility impacts, and shall not modify or change the project
without approval of the proposer.

new text begin Pollution Control Agency. new text end

new text begin The Pollution Control Agency shall amend
Minnesota Rules, part 7001.3500, subpart 1, to extend permit terms to coincide with site
capacity, design capacity, ultimate capacity, or design life as determined by the proposer,
if the permit is for a solid waste land disposal facility.

new text begin The Environmental Quality Board and the
commissioner of the Pollution Control Agency may use the good cause exemption under
Minnesota Statutes, section 14.388, subdivision 1, clause (3), to adopt rules under this
section, and Minnesota Statutes, section 14.386, does not apply except as provided in
Minnesota Statutes, section 14.388.
