  1.1                          A bill for an act 
  1.2             relating to the city of Nashwauk; modifying the 
  1.3             authority to increase benefits payable to surviving 
  1.4             spouses by the police relief association; amending 
  1.5             Laws 1943, chapter 196, section 4, as amended. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1943, chapter 196, section 4, as amended 
  1.8   by Laws 1951, chapter 44, section 1, Laws 1955, chapter 88, 
  1.9   section 1, Laws 1978, chapter 675, section 1, Laws 1991, chapter 
  1.10  28, section 1, and Laws 1992, chapter 428, section 1, is amended 
  1.11  to read: 
  1.12     Sec. 4.  [RETIREMENT AGE, PENSION.] When any member of the 
  1.13  association reaches the age of 55 years, he may retire and then 
  1.14  shall receive a pension as long as he lives, at the following 
  1.15  rates:  
  1.16     (a) When he has served as a member of the police department 
  1.17  for a period of 20 years or more, excluding temporary employment 
  1.18  or probationary periods.  Such retired member shall be paid each 
  1.19  month a pension equal to one-half of his average monthly 
  1.20  earnings during the last preceding three years of his service 
  1.21  with said police department, plus an additional $3 per month for 
  1.22  each year of service not to exceed 20 years.  
  1.23     (b) An additional $8 per month for each year of service 
  1.24  over 20 that he has served as a member of such police department 
  1.25  after the age of 55 years, not to exceed five years for purposes 
  2.1   of pension computation, 
  2.2      (c) In the event he retires after reaching the age of 55 or 
  2.3   more and after having been a member of the department for at 
  2.4   least 15 years, but before having served 20 years in the 
  2.5   department, the amount of pension which he received shall be 
  2.6   that proportion of, pension equal to one-half of his average 
  2.7   monthly earnings during the last preceding three years of his 
  2.8   service with said police department, plus an additional $3 per 
  2.9   month for each year of service.  Major fractions of years of 
  2.10  service to be treated as one year and minor fractions 
  2.11  disregarded, 
  2.12     (d) In no event shall temporary employment or employment 
  2.13  for probationary period be considered in computing pension 
  2.14  allowances hereunder, 
  2.15     (e) When a service pensioner or an active member of the 
  2.16  police department who has 20 years or more of service, dies, 
  2.17  leaving a surviving spouse or children, a pension shall be paid 
  2.18  as follows:  
  2.19     1.  To the surviving spouse a pension of $375 a month for 
  2.20  life, 
  2.21     2.  To the child or children, if their surviving parent is 
  2.22  living, a pension of $10 per month for each child not over 
  2.23  sixteen years of age, provided, the total pension hereunder for 
  2.24  surviving spouse and children of the deceased member, shall not 
  2.25  exceed the sum of $395 per month, 
  2.26     3.  A child or children of a deceased member, or after the 
  2.27  death or remarriage of their surviving parent, be entitled to 
  2.28  receive a pension or pensions of $10 per month until they have 
  2.29  reached the age of 16 years. 
  2.30     (f) The city council may, by resolution, increase the 
  2.31  pension payable to a surviving spouse by an amount equal to any 
  2.32  increase in the revised consumer price index for all urban 
  2.33  consumers for the Minneapolis-St.Paul metropolitan area prepared 
  2.34  by the United States Department of Labor, provided that no 
  2.35  increase may exceed five percent a year. 
  2.36     Sec. 2.  [LOCAL APPROVAL.] 
  3.1      Section 1 is effective on approval by the Nashwauk city 
  3.2   council and compliance with Minnesota Statutes, section 645.021.
