  1.1                          A bill for an act 
  1.2             relating to natural resources; establishing a user fee 
  1.3             for horseback riding trails; appropriating money; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 85. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [85.39] [HORSEBACK RIDING TRAIL PASS.] 
  1.8      Subdivision 1.  [PASS REQUIRED.] While horseback riding on 
  1.9   a state trail or other state lands where horseback riding is 
  1.10  permitted, a person shall carry in immediate possession a valid 
  1.11  horseback riding trail pass. 
  1.12     Subd. 2.  [FEES; VALIDITY.] (a) The fee for an annual 
  1.13  horseback riding trail pass is $5.  The fee for a three-year 
  1.14  pass is $15. 
  1.15     (b) The commissioner of natural resources or an agent 
  1.16  issuing a horseback riding trail pass under subdivision 3 may 
  1.17  charge a $1 issuing fee.  The issuing fee may be retained by the 
  1.18  seller. 
  1.19     (c) Three-year passes are valid for three years beginning 
  1.20  the July 1 previous to the date of purchase.  Annual passes are 
  1.21  valid for one year beginning the July 1 previous to the date of 
  1.22  purchase.  
  1.23     Subd. 3.  [LICENSE AGENTS.] County auditors may issue 
  1.24  horseback riding trail passes as agents of the commissioner of 
  1.25  natural resources according to section 97A.485. 
  2.1      Subd. 4.  [DISPOSITION OF FEES.] Fees from horseback riding 
  2.2   trail passes shall be deposited in the state treasury and 
  2.3   credited to the state parks account.  The money is appropriated 
  2.4   to the commissioner of natural resources for developing and 
  2.5   maintaining trails for horseback riding.
