  1.1                          A bill for an act 
  1.2             relating to the University of Minnesota; regulating 
  1.3             the selection of members of the board of regents; 
  1.4             amending Minnesota Statutes 2002, section 137.0245, 
  1.5             subdivisions 3, 4; proposing coding for new law in 
  1.6             Minnesota Statutes, chapter 137. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 137.0245, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [DUTIES.] The advisory council shall: 
  1.11     (1) develop, in consultation with current and former 
  1.12  regents and the administration of the University of Minnesota, a 
  1.13  statement of the selection criteria to be applied and a 
  1.14  description of the responsibilities and duties of a regent, and 
  1.15  shall distribute this to potential candidates; and 
  1.16     (2) for each position on the board, identify and recruit 
  1.17  qualified candidates for the board of regents, based on the 
  1.18  background and experience of the candidates, and their potential 
  1.19  for discharging the responsibilities of a member of the board of 
  1.20  regents. 
  1.21     The selection criteria developed by the advisory council 
  1.22  must contain a goal of achieving political, gender, and racial 
  1.23  balance on the board of regents.  
  1.24     Sec. 2.  Minnesota Statutes 2002, section 137.0245, 
  1.25  subdivision 4, is amended to read: 
  1.26     Subd. 4.  [RECOMMENDATIONS.] The advisory council shall 
  2.1   recommend at least two and not more than four candidates.  By 
  2.2   March January 15 of each odd-numbered year, the advisory council 
  2.3   shall submit its recommendations to the president of the senate 
  2.4   and the speaker of the house of representatives governor.  The 
  2.5   legislature governor shall not be bound by these recommendations.
  2.6      Sec. 3.  [137.0246] [GOVERNOR'S REGENT RECOMMENDATIONS.] 
  2.7      The governor shall by March 15 of each odd-numbered year 
  2.8   recommend one candidate to the president of the senate and the 
  2.9   speaker of the house of representatives for each opening for 
  2.10  which the legislature is to elect a regent.  The governor is not 
  2.11  bound to select a recommended candidate from among those 
  2.12  recommended by the regent candidate advisory council.  In making 
  2.13  recommendations, the governor shall seek to attain political, 
  2.14  gender, and racial balance on the board of regents.  The 
  2.15  legislature is not bound by the recommendation of the governor.
