  1.2             relating to the environment; making technical changes

  1.14  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.15     Section 1.  Minnesota Statutes 1998, section 115A.15, 
  1.16  subdivision 5, is amended to read: 
  1.17     Subd. 5.  [REPORTS.] (a) By January 1 of each odd-numbered 
  1.18  year, the commissioner of administration shall submit a report 
  1.19  to the governor and to the environment and natural resources 
  1.20  committees of the senate and house of representatives, the 
  1.21  finance division of the senate committee on environment and 
  1.22  natural resources, and the house of representatives committee on 
  1.23  environment and natural resources finance summarizing past 
  1.24  activities and proposed goals of the program for the following 
  1.25  biennium.  The report shall include at least: 
  1.26     (1) a summary list of product and commodity purchases that 
  1.27  contain recycled materials; 
  1.28     (2) the results of any performance tests conducted on 
  1.29  recycled products and agencies' experience with recycled 
  2.1   products used; 
  2.2      (3) a list of all organizations participating in and using 
  2.3   the cooperative purchasing program; and 
  2.4      (4) a list of products and commodities purchased for their 
  2.5   recyclability and of recycled products reviewed for purchase. 
  2.6      (b) By July 1 of each even-numbered year, the commissioner 
  2.7   of the pollution control agency director of the office of 
  2.8   environmental assistance and the commissioner of public service 
  2.9   shall submit recommendations to the commissioner regarding the 
  2.10  operation of the program. 
  2.11     Sec. 2.  Minnesota Statutes 1998, section 115A.411, 
  2.12  subdivision 1, is amended to read: 
  2.13     Subdivision 1.  [AUTHORITY; PURPOSE.] The director with 
  2.14  assistance from the commissioner shall prepare and adopt a 
  2.15  report on solid waste management policy.  The report must be 
  2.16  submitted by the director to the environment and natural 
  2.17  resources committees of the senate and house of representatives, 
  2.18  the finance division of the senate committee on environment and 
  2.19  natural resources, and the house of representatives committee on 
  2.20  environment and natural resources finance by July 1 December 1 
  2.21  of each odd-numbered year and shall include reports required 
  2.22  under sections 115A.55, subdivision 4, paragraph (b); 115A.551, 
  2.23  subdivision 4; 115A.557, subdivision 4; 473.149, subdivision 6; 
  2.24  473.846; and 473.848, subdivision 4. 
  2.25     Sec. 3.  Minnesota Statutes 1998, section 115A.52, is 
  2.26  amended to read: 
  2.27     115A.52 [TECHNICAL ASSISTANCE FOR PROJECTS.] 
  2.28     The director shall ensure the delivery of technical 
  2.29  assistance for projects eligible under the program.  The 
  2.30  director may contract or issue grants for the delivery of 
  2.31  technical assistance by any state or federal agency, a regional 
  2.32  development commission, the metropolitan council, or private 
  2.33  consultants and may use program funds to reimburse the agency, 
  2.34  commission, council, or consultants.  The director shall prepare 
  2.35  and publish an inventory of sources of technical assistance, 
  2.36  including studies, publications, agencies, and persons 
  3.1   available.  The director shall ensure statewide benefit from 
  3.2   projects assisted under the program by developing exchange and 
  3.3   training programs for local officials and employees and by using 
  3.4   the experience gained in projects to provide technical 
  3.5   assistance and education for other solid waste management 
  3.6   projects in the state. 
  3.7      Sec. 4.  Minnesota Statutes 1998, section 115A.551, 
  3.8   subdivision 2a, is amended to read: 
  3.9      Subd. 2a.  [SUPPLEMENTARY RECYCLING GOALS.] (a) By December 
  3.10  31, 1996, each county will have as a goal to recycle the 
  3.11  following amounts: 
  3.12     (1) for a county outside of the metropolitan area, 35 
  3.13  percent by weight of total solid waste generation; 
  3.14     (2) for a metropolitan county, 50 percent by weight of 
  3.15  total solid waste generation. 
  3.16     Each county will develop and implement or require political 
  3.17  subdivisions within the county to develop and implement 
  3.18  programs, practices, or methods designed to meet its recycling 
  3.19  goal.  Nothing in this section or in any other law may be 
  3.20  construed to prohibit a county from establishing a higher 
  3.21  recycling goal.  
  3.22     (b) For a county that, by January 1, 1995, is implementing 
  3.23  a solid waste reduction program that is approved by the 
  3.24  director, the director shall apply up to three percentage points 
  3.25  toward achievement of the recycling goals in this subdivision.  
  3.26  In addition, the director shall apply demonstrated waste 
  3.27  reduction that exceeds three percent reduction toward 
  3.28  achievement of the goals in this subdivision. 
  3.29     (c) No more than five percentage points may be applied 
  3.30  toward achievement of the recycling goals in this subdivision 
  3.31  for management of yard waste.  The five percentage points must 
  3.32  be applied as provided in this paragraph.  The director shall 
  3.33  apply three percentage points for a county in which residents, 
  3.34  by January 1, 1996, are provided with: 
  3.35     (1) an ongoing comprehensive education program under which 
  3.36  they are informed about how to manage yard waste and are 
  4.1   notified of the prohibition in section 115A.931; and 
  4.2      (2) the opportunity to drop off yard waste at specified 
  4.3   sites or participate in curbside yard waste collection. 
  4.4   The director shall apply up to an additional two percentage 
  4.5   points toward achievement of the recycling goals in this 
  4.6   subdivision for additional activities approved by the director 
  4.7   that are likely to reduce the amount of yard waste generated and 
  4.8   to increase the on-site composting of yard waste. 
  4.9      Sec. 5.  [REVISOR'S INSTRUCTION.] 
  4.10     (a) The revisor of statutes shall change "office," where it 
  4.11  refers to the office of waste management, to "agency" in 
  4.12  Minnesota Statutes, sections 115A.902, 115A.906, 115A.912, 
  4.13  115A.913, and 115A.914. 
  4.14     (b) The revisor of statutes shall make the following 
  4.15  changes in Minnesota Rules: 
  4.16     (1) change "waste management board" to "environmental 
  4.17  quality board" in parts 9200.3600, 9200.3700, 9200.4800, 
  4.18  9200.5000, and 9205.0500; 
  4.19     (2) change "office of waste management" to "office of 
  4.20  environmental assistance" in part 9210.0100; 
  4.21     (3) change "board," where it refers to the waste management 
  4.22  board, to "office"; "chair," where it refers to the chair of the 
  4.23  waste management board, to "director"; and "waste management 
  4.24  board" to "office of environmental assistance" in parts 
  4.25  9210.0200 to 9210.0380; and 
  4.26     (4) change "board," where it refers to the waste management 
  4.27  board, to "agency"; "waste management board" to "pollution 
  4.28  control agency"; and "chair," where it refers to the chair of 
  4.29  the waste management board, to "commissioner" in chapter 9220. 
  4.30     Sec. 6.  [REPEALER.] 
  4.31     Minnesota Rules, parts 9200.0100; 9200.0200; 9200.0300; 
  4.32  9200.0400; 9200.0500; 9200.0600; 9200.0700; 9200.0800; 
  4.33  9200.0900; 9200.1000; 9200.1100; 9200.1200; 9200.1300; 
  4.34  9200.1400; 9200.1500; 9200.1600; 9200.1700; 9200.1800; 
  4.35  9200.1900; 9200.2000; 9200.2100; 9200.2200; 9200.2210; 
  4.36  9200.2220; 9205.0600; 9205.0601; 9205.0602; 9205.0603; 
  5.1   9205.0604; 9205.0605; 9205.0606; 9205.0607; and 9205.0608, are 
  5.2   repealed.
