  1.1                          A bill for an act 
  1.2             relating to occupations and professions; permitting 
  1.3             protective agents to perform certain traffic control 
  1.4             duties; amending Minnesota Statutes 1994, section 
  1.5             326.338, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 326.338, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [PROTECTIVE AGENT.] A person who for a fee, 
  1.10  reward, or other valuable consideration undertakes any of the 
  1.11  following acts is considered to be engaged in the business of 
  1.12  protective agent: 
  1.13     (1) providing guards, private patrol, or other security 
  1.14  personnel to protect persons or their property or to prevent the 
  1.15  theft, unlawful taking of goods, merchandise, or money, or to 
  1.16  prevent the misappropriation or concealment of goods, 
  1.17  merchandise, money, or other valuable things, or to procure the 
  1.18  return of those things; 
  1.19     (2) physically responding to any alarm signal device, 
  1.20  burglar alarm, television camera, still camera, or a mechanical 
  1.21  or electronic device installed or used to prevent or detect 
  1.22  burglary, theft, shoplifting, pilferage, losses, or other 
  1.23  security measures; 
  1.24     (3) providing armored car services for the protection of 
  1.25  persons or property; 
  2.1      (4) controlling motor traffic on public streets, roads, and 
  2.2   highways for the purpose of escorting a funeral procession and 
  2.3   oversized loads; or 
  2.4      (5) providing management and control of crowds for the 
  2.5   purpose of safety and protection. 
  2.6      A person covered by this subdivision may perform the 
  2.7   traffic control duties in clause (4) in place of a police 
  2.8   officer when a special permit is required.
