  1.1                          A bill for an act 
  1.2             relating to corrections; requiring the commissioners 
  1.3             of corrections and human services to develop 
  1.4             alternative equivalent standards for chemical 
  1.5             dependency treatment programs for correctional 
  1.6             facilities under certain circumstances; amending 
  1.7             Minnesota Statutes 2000, section 241.021, subdivision 
  1.8             4a. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 241.021, 
  1.11  subdivision 4a, is amended to read: 
  1.12     Subd. 4a.  [CHEMICAL DEPENDENCY TREATMENT PROGRAMS.] All 
  1.13  residential chemical dependency treatment programs operated by 
  1.14  the commissioner of corrections to treat adults and juveniles 
  1.15  committed to the commissioner's custody shall comply with the 
  1.16  standards mandated in Minnesota Rules, parts 9530.4100 to 
  1.17  9530.6500, or successor rule parts for treatment programs 
  1.18  operated by community-based residential treatment facilities.  
  1.19  When the commissioners of corrections and human services agree 
  1.20  that these established standards for community-based programs 
  1.21  cannot reasonably apply to correctional facilities, alternative 
  1.22  equivalent standards shall be developed by the commissioners and 
  1.23  established through an interagency agreement.
