  1.1                          A bill for an act 
  1.2             relating to mental health case management services for 
  1.3             children and adults; extending the time period for 
  1.4             review of individual community support plans; 
  1.5             modifying rules extending the time period for updating 
  1.6             the community support plans and completing a 
  1.7             functional assessment of progress relative to the 
  1.8             community support plan; amending Minnesota Statutes 
  1.9             1996, sections 245.4711, subdivisions 4 and 9; and 
  1.10            245.4881, subdivision 4, and by adding a subdivision. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1996, section 245.4711, 
  1.13  subdivision 4, is amended to read: 
  1.14     Subd. 4.  [INDIVIDUAL COMMUNITY SUPPORT PLAN.] (a) The case 
  1.15  manager must develop an individual community support plan for 
  1.16  each adult that incorporates the client's individual treatment 
  1.17  plan.  The individual treatment plan may not be a substitute for 
  1.18  the development of an individual community support plan.  The 
  1.19  individual community support plan must be developed within 30 
  1.20  days of client intake and reviewed at least every 90 180 days 
  1.21  after it is developed.  The case manager is responsible for 
  1.22  developing the individual community support plan based on a 
  1.23  diagnostic assessment and a functional assessment and for 
  1.24  implementing and monitoring the delivery of services according 
  1.25  to the individual community support plan.  To the extent 
  1.26  possible, the adult with serious and persistent mental illness, 
  1.27  the person's family, advocates, service providers, and 
  1.28  significant others must be involved in all phases of development 
  2.1   and implementation of the individual or family community support 
  2.2   plan.  
  2.3      (b) The client's individual community support plan must 
  2.4   state: 
  2.5      (1) the goals of each service; 
  2.6      (2) the activities for accomplishing each goal; 
  2.7      (3) a schedule for each activity; and 
  2.8      (4) the frequency of face-to-face contacts by the case 
  2.9   manager, as appropriate to client need and the implementation of 
  2.10  the individual community support plan. 
  2.11     Sec. 2.  Minnesota Statutes 1996, section 245.4711, 
  2.12  subdivision 9, is amended to read: 
  2.13     Subd. 9.  [REVISION OF RULES.] (a) The commissioner, by 
  2.14  July 1, 1992, shall revise existing rules governing case 
  2.15  management services, in order to: 
  2.16     (1) make improvements in rule flexibility; 
  2.17     (2) establish a comprehensive coordination of services; 
  2.18     (3) require case managers to arrange for standardized 
  2.19  assessments of side effects related to the administration of 
  2.20  psychotropic medication; 
  2.21     (4) establish a reasonable caseload limit for case 
  2.22  managers; 
  2.23     (5) provide reimbursement for transportation costs for case 
  2.24  managers; and 
  2.25     (6) review the eligibility criteria for case management 
  2.26  services covered by medical assistance. 
  2.27     (b) Until rule amendments are adopted under paragraph (a), 
  2.28  in-county travel by case managers is reimbursable under the 
  2.29  medical assistance program subject to the six-hour limit on case 
  2.30  management services.  
  2.31     (c) The rules in effect on February 12, 1997, requiring 
  2.32  mental health case managers to review and update the adult's 
  2.33  individual community support plan, and the adult's functional 
  2.34  assessment every 90 days, shall be modified to require a review, 
  2.35  update, and functional assessment at least every 180 days after 
  2.36  the development of the first plan. 
  3.1      Sec. 3.  Minnesota Statutes 1996, section 245.4881, 
  3.2   subdivision 4, is amended to read: 
  3.3      Subd. 4.  [INDIVIDUAL FAMILY COMMUNITY SUPPORT PLAN.] (a) 
  3.4   For each child, the case manager must develop an individual 
  3.5   family community support plan that incorporates the child's 
  3.6   individual treatment plan.  The individual treatment plan may 
  3.7   not be a substitute for the development of an individual family 
  3.8   community support plan.  The case manager is responsible for 
  3.9   developing the individual family community support plan within 
  3.10  30 days of intake based on a diagnostic assessment and a 
  3.11  functional assessment and for implementing and monitoring the 
  3.12  delivery of services according to the individual family 
  3.13  community support plan.  The case manager must review the 
  3.14  plan at least every 90 180 calendar days after it is developed.  
  3.15  To the extent appropriate, the child with severe emotional 
  3.16  disturbance, the child's family, advocates, service providers, 
  3.17  and significant others must be involved in all phases of 
  3.18  development and implementation of the individual family 
  3.19  community support plan.  Notwithstanding the lack of an 
  3.20  individual family community support plan, the case manager shall 
  3.21  assist the child and child's family in accessing the needed 
  3.22  services listed in section 245.4884, subdivision 1.  
  3.23     (b) The child's individual family community support plan 
  3.24  must state:  
  3.25     (1) the goals and expected outcomes of each service and 
  3.26  criteria for evaluating the effectiveness and appropriateness of 
  3.27  the service; 
  3.28     (2) the activities for accomplishing each goal; 
  3.29     (3) a schedule for each activity; and 
  3.30     (4) the frequency of face-to-face contacts by the case 
  3.31  manager, as appropriate to client need and the implementation of 
  3.32  the individual family community support plan.  
  3.33     Sec. 4.  Minnesota Statutes 1996, section 245.4881, is 
  3.34  amended by adding a subdivision to read: 
  3.35     Subd. 11.  [REVISION OF RULES.] The rules in effect on 
  3.36  February 12, 1997, requiring mental health case managers to 
  4.1   review and update the child's individual community support plan, 
  4.2   and the child's functional assessment every 90 days, shall be 
  4.3   modified to require a review, update, and functional assessment 
  4.4   at least every 180 days after the development of the first plan.
