  1.1                          A bill for an act 
  1.2             relating to counties; modifying county levy authority 
  1.3             to fund statewide, shared public safety radio system; 
  1.4             amending Minnesota Statutes 2002, section 373.47, 
  1.5             subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 373.47, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [AUTHORITY TO INCUR DEBT.] (a) Subject to 
  1.10  prior approval by the public safety radio system planning 
  1.11  committee under section 473.907, the governing body of a county 
  1.12  may finance the cost of designing, constructing, and acquiring 
  1.13  public safety communication system infrastructure and equipment 
  1.14  for use on the statewide, shared public safety radio system by 
  1.15  issuing: 
  1.16     (1) capital improvement bonds under section 373.40, as if 
  1.17  the infrastructure and equipment qualified as a "capital 
  1.18  improvement" within the meaning of section 373.40, subdivision 
  1.19  1, paragraph (b); and 
  1.20     (2) capital notes under the provisions of section 373.01, 
  1.21  subdivision 3, as if the equipment qualified as "capital 
  1.22  equipment" within the meaning of section 373.01, subdivision 3. 
  1.23     (b) For purposes of this section, "county" means the 
  1.24  following counties:  Anoka, Benton, Carver, Chisago, Dakota, 
  1.25  Dodge, Fillmore, Freeborn, Goodhue, Hennepin, Houston, Isanti, 
  2.1   Mower, Olmsted, Ramsey, Rice, Scott, Sherburne, Steele, Wabasha, 
  2.2   Washington, Wright, and Winona. 
  2.3      (c) The authority to incur debt under this section is not 
  2.4   effective until July 1, 2003, for the following counties:  
  2.5   Benton, Dodge, Fillmore, Freeborn, Goodhue, Houston, Mower, 
  2.6   Olmsted, Rice, Sherburne, Steele, Wabasha, Wright, and Winona.
