  1.1                          A bill for an act 
  1.2             relating to bakeries; limiting application of certain 
  1.3             food rules to bakeries in retail food stores; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 31. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [31.78] [BAKERIES IN RETAIL FOOD STORES.] 
  1.8      Any provision of Minnesota Rules, parts 1550.1260 to 
  1.9   1550.1530, or interpretation of those parts, that requires full 
  1.10  enclosure of the portion of a building that contains ovens or 
  1.11  baking equipment or that requires an exhaust ventilation system 
  1.12  in an area containing ovens or baking equipment does not apply 
  1.13  to an oven or baking equipment in a retail food store if: 
  1.14     (1) the oven or equipment is designed exclusively for 
  1.15  baking preproofed or par-baked bread; 
  1.16     (2) the maximum design temperature of the oven or equipment 
  1.17  is 450 degrees Fahrenheit or less; 
  1.18     (3) the oven or equipment is designed to make a batch at a 
  1.19  time and not for continuous production; 
  1.20     (4) the time required to produce a loaf or batch of bread 
  1.21  in the oven or equipment is 30 minutes or less; and 
  1.22     (5) the oven or equipment is actually in use less than 25 
  1.23  percent of the time the retail food store is open to the public.
