  1.1                          A bill for an act 
  1.2             relating to education; appropriating money for school 
  1.3             breakfast and lunch programs. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [APPROPRIATIONS.] 
  1.6      Subdivision 1.  [DEPARTMENT OF EDUCATION.] The sums 
  1.7   indicated in this section are appropriated from the general fund 
  1.8   to the commissioner of education for the fiscal years designated.
  1.9      Subd. 2.  [FREE BREAKFAST GRANTS.] For grants for free 
  1.10  breakfasts to elementary school children according to Laws 1994, 
  1.11  chapter 647, article 8, section 35: 
  1.12       $86,000     .....     1996
  1.13       $88,000     .....     1997
  1.14     These grants must be made to the same four schools that 
  1.15  received grants in fiscal year 1995.  Schools that receive 
  1.16  grants must continue the free breakfast program in fiscal years 
  1.17  1996 and 1997. 
  1.18     The department of education is encouraged to solicit 
  1.19  private funds to continue the two additional pilot schools added 
  1.20  in December 1995. 
  1.21     Subd. 3.  [SCHOOL LUNCH AND FOOD STORAGE.] (a) For school 
  1.22  lunch aid according to Minnesota Statutes, section 124.646, and 
  1.23  Code of Federal Regulations, title 7, section 210.17, and for 
  1.24  food storage and transportation costs for United States 
  2.1   Department of Agriculture donated commodities; and for a 
  2.2   temporary transfer to the commodity processing revolving fund to 
  2.3   provide cash flow to permit schools and other recipients of 
  2.4   donated commodities to take advantage of volume processing rates 
  2.5   and for school milk aid according to Minnesota Statutes, section 
  2.6   124.648: 
  2.7        $7,644,000     .....     1996
  2.8        $7,839,000     .....     1997
  2.9      (b) Any unexpended balance remaining from the 
  2.10  appropriations in this subdivision shall be prorated among 
  2.11  participating schools based on the number of free, reduced, and 
  2.12  fully paid federally reimbursable student lunches served during 
  2.13  that school year. 
  2.14     (c) If the appropriation amount attributable to either year 
  2.15  is insufficient, the rate of payment for each student lunch 
  2.16  shall be reduced and the aid for that year shall be prorated 
  2.17  among participating schools so as not to exceed the total 
  2.18  authorized appropriation for that year. 
  2.19     (d) Any temporary transfer processed in accordance with 
  2.20  this subdivision to the commodity processing fund will be 
  2.21  returned by June 30 in each year so that school lunch aid and 
  2.22  food storage costs can be fully paid as scheduled. 
  2.23     (e) Not more than $800,000 of the amount appropriated each 
  2.24  year may be used for school milk aid. 
  2.25     Subd. 4.  [SCHOOL BREAKFAST.] To operate the school 
  2.26  breakfast program: 
  2.27       $514,000     .....     1996
  2.28       $530,000     .....     1997
  2.29     If the appropriation amount attributable to either year is 
  2.30  insufficient, the rate of payment for each student breakfast 
  2.31  shall be reduced and the aid for that year shall be prorated 
  2.32  among participating schools so as not to exceed the total 
  2.33  authorized appropriation for that year.  Any unexpended balance 
  2.34  remaining shall be used to subsidize the payments made for 
  2.35  school lunch aid according to Minnesota Statutes, section 
  2.36  124.646.  One-half of the appropriation for each year is to fund 
  3.1   the reimbursement under Minnesota Statutes, section 124.6469, 
  3.2   subdivision 3, paragraph (a), and one-half is to fund the 
  3.3   reimbursement under Minnesota Statutes, section 124.6469, 
  3.4   subdivision 3, paragraph (b).
