A bill for an act
relating to employment benefits; requiring carryover of unused dependent care
flexible spending account funds in benefit plan years 2020 and 2021.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CARRYOVER FOR DEPENDENT CARE FLEXIBLE SPENDING
ACCOUNTS.

new text begin (a) Notwithstanding any law to the contrary, for benefit plan years ending in 2020, a
benefit plan that includes a dependent care flexible spending arrangement shall permit
participants to carry over any unused benefits or contributions remaining in the dependent
care flexible spending arrangement from such benefit plan year to the benefit plan year
ending in 2021.
