  1.1                          A bill for an act
  1.2             relating to civil actions; providing for the survival 
  1.3             of actions for personal injury after the death of the 
  1.4             injured person; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 573; repealing Minnesota 
  1.6             Statutes 1994, section 573.01. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [573.015] [SURVIVAL OF CAUSES OF ACTION FOR 
  1.9   PERSONAL INJURY.] 
  1.10     A cause of action for injury to a person's health, 
  1.11  reputation, or person, except actions for libel and slander, 
  1.12  does not abate because of the death of the injured person or 
  1.13  because of the death of a person liable for the injury.  A 
  1.14  personal injury action survives to and in favor of the heirs, 
  1.15  legal representatives, and estate of the injured person.  The 
  1.16  action survives against the liable person and the person's legal 
  1.17  representatives.  The suit may be instituted and prosecuted as 
  1.18  if the liable person were alive. 
  1.19     Sec. 2.  [REPEALER.] 
  1.20     Minnesota Statutes 1994, section 573.01, is repealed. 
  1.21     Sec. 3.  [EFFECTIVE DATE; APPLICATION.] 
  1.22     Section 1 is effective August 1, 1995, and applies to 
  1.23  actions commenced on or after that date.
