  1.1                          A bill for an act 
  1.2             relating to boilers; modifying show boiler and engine 
  1.3             provisions; amending Minnesota Statutes 1996, section 
  1.4             183.411, subdivisions 1, 2, and 3. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 183.411, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [DEFINITION.] For the purpose of this 
  1.9   section chapter, the terms "stationary show boiler" and "hobby 
  1.10  boiler" means are synonymous and mean a boiler that is used only 
  1.11  for display and demonstation purposes.  In recognition of the 
  1.12  historical significance of show boilers in maintaining a working 
  1.13  reminder of Minnesota's agricultural, transportation, and lumber 
  1.14  industries, show boilers and engines are considered to be 
  1.15  historical artifacts. 
  1.16     Sec. 2.  Minnesota Statutes 1996, section 183.411, 
  1.17  subdivision 2, is amended to read: 
  1.18     Subd. 2.  [INSPECTION.] When used only for display and 
  1.19  demonstration purposes, steam farm traction engines, portable 
  1.20  and stationary show engines and portable and stationary show 
  1.21  boilers shall be inspected every two years according to law. 
  1.22     (a) Show boilers or show engines of lap seam construction 
  1.23  not certified in Minnesota or previously certified in Minnesota 
  1.24  but that have been repaired or altered after certification, may 
  1.25  be certified in Minnesota if:  
  2.1      (1) all alterations have been done in accordance with 
  2.2   American National Standard ANSI/NB23 R-404 or R-505; or 
  2.3      (2) form R-1, report of alteration, has been prepared by a 
  2.4   registered professional engineer with verification by the 
  2.5   authorized inspection agency responsible for the in-service 
  2.6   inspection of the object in accordance with American National 
  2.7   Standard ANSI/NB23 R-502; or 
  2.8      (3) the engine has received a certificate allowing 
  2.9   operation, or repairs have been authorized under American 
  2.10  National Standard ANSI/NB23 R-404.1, R-404.2, or R-404.3 in 
  2.11  Minnesota or another jurisdiction that accepts the provisions of 
  2.12  American National Standard ANSI/NB23 and an inspection has been 
  2.13  completed by an inspector certified in Minnesota according to 
  2.14  the standards set in paragraph (b). 
  2.15     (b) A hobby boiler or show engine, not certified in 
  2.16  Minnesota or any other jurisdiction must successfully complete, 
  2.17  at the owner's expense, inspection by:  
  2.18     (1) full radiographic examination or ultrasonic examination 
  2.19  or dye-penetrant examination or none of the above, at the 
  2.20  discretion of the boiler inspector, of the long or longitudinal 
  2.21  seam of lap-seam construction; and shall be inspected thoroughly 
  2.22  by a boiler inspector certified to inspect boilers in Minnesota, 
  2.23  using inspection standards in paragraph (b), before being 
  2.24  certified for use in Minnesota. 
  2.25     (b) Standards for inspection of show boilers shall be those 
  2.26  established by the National Board Inspection Code ANSI/NB23 and 
  2.27  by the rules adopted by the department of labor and industry, 
  2.28  division of boiler inspection, and as follows: 
  2.29     (1) the boiler shall be subjected to the appropriate method 
  2.30  of nondestructive examination, at the owner's expense, as deemed 
  2.31  necessary by the boiler inspector to determine soundness and 
  2.32  safety of the boiler; 
  2.33     (2) the boiler shall be tested by ultrasonic examination 
  2.34  for metal thickness (for purposes of calculating the maximum 
  2.35  allowable working pressure the thinnest reading shall be used - 
  2.36  see also American National Standard ANSI/NB23 I-303.8 and a 
  3.1   safety factor of six shall be used in calculating maximum 
  3.2   allowable working pressure on all non-ASME-code hobby and show 
  3.3   boilers); and 
  3.4      (3) magnetic particle or radiographic examination of areas 
  3.5   where dye penetrant testing shows possible cracks; and 
  3.6      (4) hydrostatic testing at 1-1/2 maximum allowable working 
  3.7   pressure.; and 
  3.8      (3) repairs and alterations made to show boilers must be 
  3.9   made pursuant to section 183.466.  
  3.10     (c) Further each such object shall successfully complete an 
  3.11  inspection of:  
  3.12     (1) the fusible plug; 
  3.13     (2) the safety valve, which must be of American Society of 
  3.14  Mechanical Engineer's approved design and set at the maximum 
  3.15  allowable working pressure and sealed in an appropriate manner 
  3.16  not allowing tampering with the valve setting without destroying 
  3.17  the seal; and 
  3.18     (3) the boiler power piping.  
  3.19     Any longitudinal cracks found in riveted longitudinal seams 
  3.20  requires that the vessel be sealed and not approved for use in 
  3.21  Minnesota.  If the boiler or show engine is jacketed, the jacket 
  3.22  must be removed prior to inspection. 
  3.23     Sec. 3.  Minnesota Statutes 1996, section 183.411, 
  3.24  subdivision 3, is amended to read: 
  3.25     Subd. 3.  [LICENSES.] A license to operate steam farm 
  3.26  traction engines, portable and stationary show engines and 
  3.27  portable and stationary show boilers shall be issued to an 
  3.28  applicant who: 
  3.29     (a) is 18 years of age or older; 
  3.30     (b) has two a licensed second class, grade A engineers or 
  3.31  higher class engineer or steam traction engineers, or any 
  3.32  combination thereof, cosign (hobby) engineer sign the 
  3.33  application; affidavit attesting to the applicant's competence 
  3.34  in operating said devices; 
  3.35     (c) passes a written test for competence in operating said 
  3.36  devices; 
  4.1      (d) has at least 25 hours of actual operating experience on 
  4.2   said devices; and 
  4.3      (e) pays the required fee. 
  4.4      A license shall be valid for the lifetime of the licensee.  
  4.5   A one time fee set by the commissioner pursuant to section 
  4.6   16A.1285, shall be charged for the license.
