  1.1                          A bill for an act 
  1.2             relating to education; allowing for direct judicial 
  1.3             review of district exclusion and expulsion decisions; 
  1.4             amending Minnesota Statutes 2002, section 121A.50; 
  1.5             repealing Minnesota Statutes 2002, section 121A.49.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 121A.50, is 
  1.8   amended to read: 
  1.9      121A.50 [JUDICIAL REVIEW.] 
  1.10     The decision of the commissioner of children, families, and 
  1.11  learning school district made under sections 121A.40 to 121A.56 
  1.12  is subject to judicial review under sections 14.63 to 
  1.13  14.69.  The decision of the commissioner is stayed pending an 
  1.14  appeal under this section. 
  1.15     [EFFECTIVE DATE.] This section is effective the day 
  1.16  following final enactment and applies to all appeals of school 
  1.17  district decisions made after that date.  
  1.18     Sec. 2.  [REPEALER.] 
  1.19     Minnesota Statutes 2002, section 121A.49, is repealed. 
  1.20     [EFFECTIVE DATE.] This section is effective the day 
  1.21  following final enactment.
