  1.1                          A bill for an act
  1.2             relating to traffic regulations; providing for 
  1.3             surcharge on fine for failure to move vehicle safely 
  1.4             away from stopped emergency vehicle; requiring certain 
  1.5             material be included in Minnesota driver's manual; 
  1.6             amending Minnesota Statutes 2002, section 169.18, 
  1.7             subdivision 11; 171.13, by adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 169.18, 
  1.10  subdivision 11, is amended to read: 
  1.11     Subd. 11.  [PASSING PARKED EMERGENCY VEHICLE.] (a) When 
  1.12  approaching and before passing an authorized emergency vehicle 
  1.13  that is parked or otherwise stopped on or next to a street or 
  1.14  highway having two or more lanes in the same direction, the 
  1.15  driver of a vehicle shall safely move the vehicle to a lane away 
  1.16  from the emergency vehicle. 
  1.17     (b) A person who violates paragraph (a) is assessed an 
  1.18  additional surcharge equal to the amount of the fine imposed for 
  1.19  the violation, but not less than $25. 
  1.20     Sec. 2.  Minnesota Statutes 2002, section 171.13, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 1i.  [DRIVER'S MANUAL; EMERGENCY VEHICLES.] The 
  1.23  commissioner shall include in each edition of the driver's 
  1.24  manual published by the department after August 1, 2003, a 
  1.25  section relating to the responsibilities of drivers to (1) drive 
  1.26  at an appropriate reduced speed when approaching an emergency 
  2.1   vehicle stopped on a highway as required under section 169.14, 
  2.2   subdivision 3, and (2) move vehicles to a lane safely away from 
  2.3   an emergency vehicle stopped on a highway as required under 
  2.4   section 169.18, subdivision 11.
