A bill for an act
relating to unemployment insurance; temporarily modifying eligibility for secondary
students 16 years of age or older; appropriating money.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding Minnesota Statutes, section 268.085, subdivision 2, clause (3), an
applicant 16 years of age or older who is a student in attendance at, doing distance learning
through, or on vacation from a secondary school, including the period between academic
years or terms, applying for an unemployment insurance benefits account established between
March 15, 2020, and December 30, 2020, is not ineligible for unemployment benefits. The
effect on future tax rate exemption provided in Laws 2020, chapter 71, article 2, section 24,
applies to this section.

This section is effective the day following final enactment and
is retroactive from March 16, 2020. This section expires on December 30, 2020, or when
the appropriation in section 2 has been fully expended.

$27,900,000 is appropriated in fiscal year 2021 from the coronavirus relief federal fund
to the commissioner of employment and economic development for deposit in the
unemployment insurance trust fund established under Minnesota Statutes, section 268.194,
for unemployment benefits for the applicants specified in section 1. Before any benefit
amounts are paid to applicants under section 1, the commissioner of management and budget
shall determine whether such payments are an allowable use of the funds in the coronavirus
relief federal fund. If the commissioner determines the appropriation in this section is not
an allowable use of the funds under federal law, the unemployment benefits in section 1
shall not be paid. This is a onetime appropriation.
