A bill for an act
relating to human services; requiring the commissioner of administration to
develop requests for proposals to select vendors to operate certain Minnesota
state-operated community services programs.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin REQUEST FOR PROPOSALS FOR DAY TRAINING AND
HABILITATION VENDORS.

new text begin Issuance of request for proposals; selection of vendors
for Minnesota state-operated community services (MSOCS); day training and
habilitation programs (DTH).

new text begin (a) The commissioner of administration, in consultation
with the advocates and professionals with demonstrated experience in providing day
services to individuals with developmental disabilities that are medically and behaviorally
complex, shall develop a request for proposals to operate the day training and habilitation
programs currently operated by the state-operated services division in the Department of
Human Services. The commissioner shall issue the requests for proposals by October
1, 2011. The requests must remain open until December 15, 2011. Upon receipt and
evaluation of the responses to the requests for proposals, and before selecting vendors to
operate the DTH programs, the commissioner of administration shall provide the proposals
and the commissioner's evaluation of the proposals to the chairs of the senate and house of
representatives committees with jurisdiction over human services issues. Within 14 days
after receiving the proposals, the chairs shall advise the commissioner on which proposals
should be selected. By January 15, 2012, the commissioner shall select vendors to operate
the programs. On July 1, 2012, the vendors shall begin operating the programs.

proposals by the deadline under paragraph (a), the commissioner of administration shall
allow the continuation of state operation of the programs, and make recommendations by
January 15, 2012, to the chairs of the senate and house of representatives committees with
jurisdiction over human services issues as to whether the commissioner of administration
should develop another request for proposal for the remaining state-operated programs.

commissioner of human services. The programs must be operated by vendors selected
by the commissioner of administration. Individuals may remain in the program if a
satisfactory arrangement can be made with the new vendor chosen to operate the program.

human services are governed by applicable provisions of collective bargaining agreements
and personnel policies affecting the employees.

proposals to operate the adult foster care programs currently operated by the state-operated
services division in the Department of Human Services. The commissioner shall issue
the requests for proposals by October 1, 2011. The requests must remain open until
December 15, 2011. Upon receipt and evaluation of the responses to the requests for
proposals, and before selecting vendors to operate the adult foster care, the commissioner
of administration shall provide the proposals and the commissioner's evaluation of the

demonstrated experience in providing intensive therapeutic treatment in a foster care
setting for children and adolescents, shall develop a request for proposals to operate
MITH currently operated by the state-operated services division in the Department of
Human Services. The commissioner shall issue the requests for proposals by October
1, 2011. The requests must remain open until December 15, 2011. Upon receipt and
evaluation of the responses to the requests for proposals, and before selecting vendors
to operate MITH, the commissioner of administration shall provide the proposals and
the commissioner's evaluation of the proposals to the chairs of the senate and house of
representatives committees with jurisdiction over human services issues. Within 14 days
after receiving the proposals, the chairs shall advise the commissioner on which proposals
should be selected. By January 15, 2012, the commissioner shall select vendors to operate
MITH. On July 1, 2012, the vendors shall begin operating MITH.
