A resolution
memorializing the Congress of the United States not to reauthorize the No Child
Left Behind Act.

WHEREAS, although the intent is worthy, the No Child Left Behind Act represents a
wrongful and unacceptable federal intrusion into state and local control of education, which
violates time-honored American principles of balanced federalism and respect for state and
local prerogatives; and

WHEREAS, the No Child Left Behind Act coerces participation by placing punitive
financial consequences on states who might choose not to participate; and

WHEREAS, the No Child Left Behind Act is an unfunded mandate causing states and
school districts to spend more money to implement the No Child Left Behind Act than what
Congress appropriates; and

WHEREAS, the No Child Left Behind Act is contrary to the Tenth Amendment of the
United States Constitution, which restricts the powers of the federal government to those so
delegated by the United States Constitution and reserves powers not delegated to the federal
government, such as education, to the states and to the people; NOW, THEREFORE,

BE IT RESOLVED by the Legislature of the State of Minnesota that it urges the Congress
of the United States to repeal the No Child Left Behind Act.

BE IT FURTHER RESOLVED by the Legislature of the State of Minnesota that it urges
the Congress of the United States to only provide education funding to the states in the form of
education block grants and for meeting shortfalls under the federal Individuals with Disabilities
Education Act.

BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is
directed to prepare copies of this memorial and transmit them to the President and the Secretary of
the United States Senate, the Speaker and the Clerk of the United States House of Representatives,
the chair of the Senate Committee on Health, Education, Labor, and Pensions, the chair of the
House Committee on Education and the Workforce, and Minnesota's Senators and Representatives
in Congress so that may be apprised of the sense of the Minnesota Legislature in this matter.
