A bill for an act
relating to liquor; authorizing the sale of bottled wine with gift baskets with
certain conditions; proposing coding for new law in Minnesota Statutes, chapter
340A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Notwithstanding section 340A.401 or any other law, local ordinance, or charter
provision to the contrary, a person may offer and sell bottled wine that is included with a
gift basket. Sales authorized under this section must be exclusively by mail and may not
be conducted on the premises of the person's place of business.

new text begin (b) The shipping container of any gift basket containing bottled wine sent under this
section must be clearly marked "Alcoholic Beverages: adult signature (over 21 years
of age) required."

new text begin (c) It is not the intent of this section to impair the distribution of wine through
distributors or importing distributors, but only to permit shipments of gift baskets
containing bottled wine for limited, commercial purposes.

new text begin (d) A person is not considered a retailer of intoxicating liquor and is not required to
be licensed under this chapter if the person complies with the requirements of this section.
