  1.1                          A bill for an act 
  1.2             relating to education; repealing and replacing the 
  1.3             profile of learning; requiring legislative review of 
  1.4             proposed statewide rigorous core academic standards in 
  1.5             language arts, mathematics, science, and history and 
  1.6             geography; repealing portions of Minnesota Rules, 
  1.7             chapter 3501; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 120B. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [120B.001] [REPEALING PROFILE OF LEARNING 
  1.11  STATUTES AND RULES.] 
  1.12     Notwithstanding sections 120B.02, 120B.031, 120B.30, 
  1.13  120B.31, and 120B.35, or other law to the contrary, the 
  1.14  commissioner of children, families, and learning must not 
  1.15  implement the profile of learning portion of the state's 
  1.16  results-oriented graduation rule and all rules under Minnesota 
  1.17  Rules, chapter 3501, related to the profile of learning portion 
  1.18  of the state's results-oriented graduation rule described in 
  1.19  this chapter are repealed. 
  1.20     [EFFECTIVE DATE.] This section is effective the day 
  1.21  following final enactment and applies to the 2003-2004 school 
  1.22  year and later. 
  1.23     Sec. 2.  [REPLACING PROFILE OF LEARNING STATUTES AND 
  1.24  RULES.] 
  1.25     The commissioner of children, families, and learning must 
  1.26  obtain and consider advice from at least the following 
  1.27  stakeholders in proposing to the legislature statewide rigorous 
  2.1   core academic standards in language arts, mathematics, science, 
  2.2   and history and geography: 
  2.3      (1) parents of school-age children and members of the 
  2.4   public throughout the state; 
  2.5      (2) teachers throughout the state currently licensed and 
  2.6   providing instruction in language arts, mathematics, science, or 
  2.7   history and geography and licensed elementary and secondary 
  2.8   school principals throughout the state currently administering a 
  2.9   school site; 
  2.10     (3) currently serving members of local school boards and 
  2.11  charter school boards throughout the state; 
  2.12     (4) representatives of higher education institutions in 
  2.13  Minnesota; 
  2.14     (5) nationally recognized experts on developing statewide 
  2.15  rigorous core academic standards; and 
  2.16     (6) representatives of the Minnesota business community. 
  2.17     The commissioner must present to the legislature by April 
  2.18  15, 2003, a written proposal for statewide rigorous core 
  2.19  academic standards in language arts, mathematics, science, and 
  2.20  history and geography and the process for implementing the 
  2.21  proposal, consistent with the timeline established in this act. 
  2.22     [EFFECTIVE DATE.] This section is effective the day 
  2.23  following final enactment. 
  2.24     Sec. 3.  [LEGISLATIVE REVIEW OF PROPOSED STATEWIDE RIGOROUS 
  2.25  CORE ACADEMIC STANDARDS.] 
  2.26     (a) Consistent with the legislature's intent to ensure that 
  2.27  statewide rigorous core academic standards in language arts, 
  2.28  mathematics, science, and history and geography are implemented 
  2.29  throughout the state, the legislature must review the proposal 
  2.30  of the commissioner of children, families, and learning under 
  2.31  section 2 and specifically enact statewide rigorous core 
  2.32  academic standards before the commissioner implements such 
  2.33  standards.  The commissioner, in anticipation of the 
  2.34  legislature's action, must not implement any standards until the 
  2.35  legislature enacts such standards. 
  2.36     (b) If the legislature does not enact statewide rigorous 
  3.1   core academic standards in language arts, mathematics, science, 
  3.2   and history and geography before the start of the 2003-2004 
  3.3   school year, each school district and charter school shall 
  3.4   continue to implement academic standards consistent with 
  3.5   Minnesota Statutes, section 120A.22, subdivision 9, and 
  3.6   applicable federal law until statewide rigorous core academic 
  3.7   standards in language arts, mathematics, science, and history 
  3.8   and geography are enacted. 
  3.9      [EFFECTIVE DATE.] This section is effective the day 
  3.10  following final enactment.
