A bill for an act
relating to public safety; proposing new penalties for repeat violators of certain
motor vehicle property crimes; amending Minnesota Statutes 2010, section
609.546.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 609.546, is amended to read:


609.546 MOTOR VEHICLE TAMPERING.

A person is guilty of a misdemeanor who
intentionally:

(1) rides in or on a motor vehicle knowing that the vehicle was taken and is being
driven by another without the owner's permission; or

(2) tampers with or enters into or on a motor vehicle without the owner's permission.

new text begin A person is guilty of a gross misdemeanor who
violates subdivision 1 after having been previously convicted of or adjudicated delinquent
two or more times for violating subdivision 1; section 609.52, subdivision 2, clause (17);
609.53; 609.59; or 609.595.

new text begin A person is guilty of a felony who violates subdivision 1 after
having been previously convicted of or adjudicated delinquent four or more times for
