  1.1                          A bill for an act 
  1.2             relating to state government; allocating certain 
  1.3             appropriations to regional arts councils; amending 
  1.4             Minnesota Statutes 1994, section 129D.01; proposing 
  1.5             coding for new law in Minnesota Statutes, chapter 129D.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 129D.01, is 
  1.8   amended to read: 
  1.9      129D.01 [DEFINITIONS.] 
  1.10     As used in this chapter, the following terms shall have the 
  1.11  definitions given them: 
  1.12     (a) "Arts" means activities resulting in the artistic 
  1.13  creation or artistic performance of works of the imagination.  
  1.14  Artistic activities include but are not limited to the following 
  1.15  forms:  music, dance, drama, folk art, architecture and allied 
  1.16  fields, painting, sculpture, photography, graphic and craft 
  1.17  arts, costume and fashion design, motion pictures, television, 
  1.18  radio, tape and sound recording, activities related to the 
  1.19  presentation, performance, execution, and exhibition of the art 
  1.20  forms, and the study of the arts and their application to the 
  1.21  human environment; 
  1.22     (b) "Board" means the board of the arts; 
  1.23     (c) "Director" means the executive director of the board; 
  1.24     (d) "Sponsoring organization" means an association, 
  1.25  corporation or other group of persons (1) providing an 
  2.1   opportunity for citizens of the state to participate in the 
  2.2   creation, performance or appreciation of the arts and (2) 
  2.3   qualifying as a tax-exempt organization within the meaning of 
  2.4   section 290.05, subdivision 1, clause (i).  
  2.5      (e) "Regional arts council" means an autonomous grass-roots 
  2.6   organization designated by the board to make final decisions on 
  2.7   the use of appropriations for local or regional arts development.
  2.8      Sec. 2.  [129D.045] [REGIONAL ARTS COUNCILS.] 
  2.9      A portion of each appropriation to the board must be used 
  2.10  for statewide distribution through the regional arts council 
  2.11  system.  These organizations shall work together to determine a 
  2.12  formula for distributing the funds to the regions.  The board 
  2.13  serves as fiscal agent for distribution of the funds to each 
  2.14  regional arts council.
