A bill for an act
relating to agriculture; restricting sales of ethanol
plants; amending Minnesota Statutes 2004, section
41A.09, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 41A.09, is
amended by adding a subdivision to read:

new text begin (a)
A producer shall refund all payments received under subdivision
3a if the producer sells an ethanol plant that has produced
ethanol that has been reported for producer payments made under
this section in the 20 years preceding the date of sale. The
commissioner of agriculture shall deposit the refund in the
general fund.

new text begin (b) Paragraph (a) does not apply to the sale of an ethanol
plant to a farmer-owned cooperative organized under chapter 308A.

new text begin (c) The amount deposited under paragraph (a) is
appropriated from the general fund to the commissioner for
payments under subdivision 3a, and is available until expended.
