  1.1                          A bill for an act 
  1.2             relating to health; modifying licensing provisions for 
  1.3             plumbers and water conditioning contractors; amending 
  1.4             Minnesota Statutes 1996, sections 326.41; 326.42; and 
  1.5             326.62; repealing Minnesota Statutes 1996, sections 
  1.6             326.40, subdivision 5; and 326.601, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 326.41, is 
  1.9   amended to read: 
  1.10     326.41 [ADVISORY COUNCIL.] 
  1.11     The state commissioner of health shall appoint nine persons 
  1.12  individuals to the advisory council on plumbing code and 
  1.13  examinations, two of whom shall be master plumbers, one who 
  1.14  represents greater Minnesota and one who represents the 
  1.15  metropolitan area, and two journeyman plumbers, one who 
  1.16  represents greater Minnesota and one who represents the 
  1.17  metropolitan area.  The council shall expire and the terms, 
  1.18  compensation and removal of members of the council shall be as 
  1.19  provided in section 15.059.  The membership shall include at 
  1.20  least one master plumber representing greater Minnesota, one 
  1.21  master plumber representing the metropolitan area, one 
  1.22  journeyman plumber representing the metropolitan area, one 
  1.23  registered engineer, one building official or inspector, and one 
  1.24  representative of the commissioner.  The advisory council is 
  1.25  governed by section 15.059, except section 15.059, subdivision 
  1.26  5, does not apply. 
  2.1      Sec. 2.  Minnesota Statutes 1996, section 326.42, is 
  2.2   amended to read: 
  2.3      326.42 [APPLICATIONS, FEES.] 
  2.4      Subdivision 1.  [APPLICATION; EXAMINATION.] Applications 
  2.5   for plumber's license shall be made to the state commissioner of 
  2.6   health, with fee.  Unless the applicant is entitled to a 
  2.7   renewal, the applicant shall be licensed by the state 
  2.8   commissioner of health only after passing a satisfactory 
  2.9   examination by the examiners showing fitness.  Examination fees 
  2.10  for both journeyman and master plumbers shall be in an amount 
  2.11  prescribed by the state commissioner of health pursuant to 
  2.12  section 144.122.  
  2.13     Subd. 2.  [FEES.] (a) Upon being notified that of having 
  2.14  successfully passed passing the examination for original 
  2.15  license, the applicant shall submit an application, with the 
  2.16  license fee herein provided.  License fees shall be in an amount 
  2.17  prescribed by the state commissioner of health pursuant to 
  2.18  section 144.122.  
  2.19     (b) The fee for a master plumber license or for a renewal 
  2.20  of a master plumber license is $240.  An application for master 
  2.21  plumber license submitted during the second half of the 
  2.22  licensing period must be accompanied by a $120 fee.  A master 
  2.23  plumber who files a bond and evidence of liability insurance 
  2.24  under section 326.40 shall pay an additional fee of $80 per 
  2.25  license period. 
  2.26     (c) After January 1, 1999, the fee for a journeyman plumber 
  2.27  license or for a renewal of a journeyman plumber license is 
  2.28  $110.  An application for a journeyman plumber license submitted 
  2.29  during the second half of the licensing period must be 
  2.30  accompanied by a $55 fee. 
  2.31     Subd. 3.  [TERM.] Licenses shall expire and be renewed as 
  2.32  prescribed by the commissioner pursuant to section 
  2.33  144.122.  After January 1, 1998, the license period for a master 
  2.34  plumber is two years.  After January 1, 1999, the license period 
  2.35  for a journeyman plumber is two years. 
  2.36     Sec. 3.  Minnesota Statutes 1996, section 326.62, is 
  3.1   amended to read: 
  3.2      326.62 [APPLICATIONS; FEES.] 
  3.3      Subdivision 1.  [APPLICATION; FEES.] (a) Applications for 
  3.4   water conditioning contractor's or installer's licenses shall be 
  3.5   made to the state commissioner of health with the fee prescribed 
  3.6   by the commissioner pursuant to section 144.122.  
  3.7      (b) After January 1, 1998, the fee for a water conditioning 
  3.8   contractor license or for a renewal of a water conditioning 
  3.9   contractor license is $140.  An application for a water 
  3.10  conditioning contractor license submitted during the second half 
  3.11  of the licensing period must be accompanied by a $70 fee.  A 
  3.12  water conditioning contractor who files a bond and evidence of 
  3.13  liability insurance under section 326.601 shall pay an 
  3.14  additional fee of $80 per license period.  
  3.15     (c) After January 1, 1998, the fee for a water conditioning 
  3.16  installer license or for a renewal of a water conditioning 
  3.17  installer license is $35.  An application for a water 
  3.18  conditioning installer license submitted during the second half 
  3.19  of the licensing period must be accompanied by a $17.50 fee. 
  3.20     Subd. 2.  [TERM.] Licenses shall expire and be renewed as 
  3.21  prescribed by the commissioner pursuant to section 
  3.22  144.122.  After January 1, 1998, the license period for a water 
  3.23  conditioning contractor and a water conditioning installer is 
  3.24  two years. 
  3.25     Sec. 4.  [REPEALER.] 
  3.26     Minnesota Statutes 1996, sections 326.40, subdivision 5; 
  3.27  and 326.601, subdivision 4, are repealed.
